RESOLUTION NO. 2006-409
AUTHORIZING THE VACATION OF
CERTAIN DRAINAGE AND UTILITY EASEMENTS WITHIN
LOT 2, BLOCK 1, BASS CREEK BUSINESS PARK 4TH ADDITION (2006056)
WHEREAS, a public hearing with respect to said vacation was scheduled for October 10, 2006 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of October 10, 2006; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on October 10, 2006 to inform any and all
interested parties relevant to the vacation of drainage and utility easements in Bass Creek Business
Park 4th Addition; and
WHEREAS, it was determined by the City Council that said easements were not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easements be vacated:
That part of the 20 foot wide Utility Easement lying within Lot 2, Block 1, BASS CREEK BUSINESS
PARK 4TH ADDITION, dedicated in said plat of BASS CREEK BUSINESS PARK 4TH
ADDITION, which lies southerly of the southwesterly extension of a southeasterly line of said Utility
Easement which centerline has a record bearing of North 33 degrees 13 minutes 47 seconds East.
Together with that part of the 20 foot wide Utility Easement running in a north -south direction,
dedicated in the plat of BASS LAKE CORPORATE CENTER ADDITION, which lies within said Lot
2.

Together with that part of the 40 foot wide Utility Easement dedicated in the plat of BASS CREEK
BUSINESS PARK ADDITION which lies within said Lot 2.
Together with that part of the 20 foot wide Sanitary Sewer Easement per Document No. 1805922
which lies within said Lot 2.
All in Hennepin County, Minnesota.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
