RESOLUTION 2006-399
APPROVING ENCROACHMENT AGREEMENT FOR
A DECK AND RETAINING WALL TO OCCUPY A DRAINAGE AND UTILITY
EASEMENT WITHIN LOT 14, BLOCK 3, FAWN CREEK - 4405 WESTON LANE
WHEREAS, Scott and Kris Ebert have requested approval to execute an encroachment agreement
to constrict a deck and retaining wall; and;
WHEREAS, the encroachment agreement only permits the encroachment of the deck and retaining
wall within the easement and all related facilities must still meet all applicable City codes; and
WHEREAS, the property is legally described as Lot 14, Block 3, Fawn Creek;
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for a portion of the deck
to cantilever into the easement along with a concrete footing and an existing retaining wall.
Adopted by the City Council on October 10, 2006.
