HomeMy WebLinkAboutCity Council Resolution 2006-392CITY OF PLYMOUTH RESOLUTION 2006-392 APPROVING A REGISTERED LAND SURVEY TO SUBDIVIDE PROPERTY IN PLYMOUTH STATION FOR A DAY CARE FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF DUNKIRK LANE AND MEDINA ROAD. (2006091) WHEREAS, Hans Hagen Homes, Inc. has requested approval of a registered land survey to subdivide a property to allow the constriction of a daycare located at the northwest corner of the intersection of Dunkirk Lane and Medina Road, and WHEREAS, the property is legally described as follows: That part of Lot 1, Block 1 Plymouth Station, which lies southerly, southwesterly and westerly of the centerline of Medina Road and the northerly line of Dunkirk Lane (and its westerly continuation) as both are dedicated in the plat of Seven Ponds Second Addition. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hans Hagen Homes, Inc. for a registered land survey to a property to allow the constriction of a daycare located at the northwest corner of the intersection of Dunkirk Lane and Medina Road, subject to the following findings and conditions: 1. The registered land survey is approved in accordance with the application and plans received by the City on September 11, 2006, except as may be amended by this Resolution. 2. All properties are subject to the requirements of the Plymouth Station PUD. Resolution 2006-392 (2006091) Page 2 3. Tract B shall be combined with the remainder of Lot 1, Block 1 Plymouth Station (abstract property). 4. Prior to the issuance of any permits, the applicant shall a) fiirnish a recorded copy of the Registered Land Survey to the City and b) submit proof that Hennepin County has combined Tract B with the remainder of Lot 1, Block 1 Plymouth Station. 5. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
