HomeMy WebLinkAboutCity Council Resolution 2006-385CITY OF PLYMOUTH RESOLUTION 2006-385 APPROVING A PRELIMINARY PLAT FOR CSM EQUITIES, LLC FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF HIGHWAY 55 AND NORTHWEST BOULEVARD (2006030) WHEREAS, CSM Equities, LLC has requested approval of a preliminary plat for property currently legally described as follows: Lot 1, Block 1, Northwest Business Campus 4TH Addition, except that part lying Southeasterly of the following described line: Beginning at a point in the Southwesterly line of said Lot 1 distant 10 feet Northwesterly of the most Southerly corner thereof, thence run Northeasterly to a point on the Southeasterly line of said Lot 1 distant 53.79 feet Northeasterly of said most Southerly corner as measured along Southeasterly line and there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CSM Equities, LLC for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved for property located at the northwest corner of Highway 55 and Northwest Boulevard, in accordance with the plans received by the City on August 11, 2006, except as may be amended by this resolution. 2. No building permits shall be issued until the final plat is recorded with Hennepin County, and the PUD final plan is approved by the City. 3. The developer shall obtain the appropriate permits or approvals from Hennepin County, Mn/DOT, Bassett Creek Watershed, City of Plymouth (right-of-way), and NPDES. Prior to recording the final plat, the developer shall: a. pay $13,250 in tree restitution to the City of Plymouth; b. provide easements for the trail along Northwest Boulevard and for the Sidewalks along Campus Drive and Annapolis Circle; c. provide cross -access, cross -parking, and cross water supply easements; and d. submit the required utility and drainage easements, as approved by the City Engineer. 5. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. c. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
