RESOLUTION 2006-364
APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY PRESENTLY
ADDRESSED AS 18420-8THAVENUE NORTH (2006046)
WHEREAS, BohLand Hadley Woods, LLC has requested reclassification of the zoning from
FRD (Future Restricted Development) to RSF-1 (Single Family Detached 1) for roughly 24.2
acres (12.8 net acres) legally described as follows:
That part of the West Half of Section 31, Township 118, Range 22 in Hennepin County,
Minnesota; described as follows, to -wit: Beginning at a point in the North line of the
Southeast Quarter of Northwest Quarter of said Section 31, 240 feet west of the Northeast
corner of said Southeast Quarter of Northwest Quarter of said Section 31; thence West on
the North line of said Southeast Quarter of Northwest Quarter of said Section 31, 1066.25
feet more or less, to the Northwest corner of said Southeast Quarter of Northwest Quarter of
said Section 31; thence South along the West line of said Southeast Quarter of Northwest
Quarter of said Section 31, 300.9 feet; thence Southeasterly along a line which, if extended,
would intersect the North and South Quarter Section line of said Section 31 at a point 646.8
feet south of the center of said section to a point in said line which is 240 feet West
(measured at right angles) of said North and South Quarter Section line; thence North
parallel with the North and South Quarter Section line of said section, 1651.92 feet to the
point of beginning.
Being registered land as is evidenced by Certificate of Title No. 1053500.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance rezoning the affected property from FRD
(Future Restricted Development) to RSF-1 (Single Family Detached 1).

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for
reclassification of the zoning from FRD (Future Restricted Development) to RSF-I (Single
Family Detached 1) for the roughly 24.2 acres (12.8 net acres) presently addressed as 18420-8"'
Avenue North, based on the following findings:
1. The proposed RSF-I zoning classification is consistent with the LA -I guiding of the
Comprehensive Plan.
2. All lots would meet or exceed the lot standards specified by the RSF-I zoning district, as
outlined in the preliminary plat section of this report.
3. The proposed lower density for this site would result in a development that balances
preservation of the environment with reasonable and responsible use of land—and would
also result in less impervious surface coverage, thereby reducing runoff to the lake.
Furthermore, the proposed lower density would result in a development that would be more
compatible with the existing character of the surrounding neighborhoods.
4. The proposed RSF-I zoning classification would help to preserve and maintain the
established larger lot development pattern of the adjacent neighborhoods.
5. Adequate infrastructure is available to support RSF-I zoning and the development proposed
for this site.
