RESOLUTION 2006-359
APPROVING PUD AMENDMENT TO ALLOW CONSTRUCTION OF AN 8,100 -SQUARE FOOT
DAYCARE FOR PROPERTY LOCATED AT 16605 COUNTY ROAD 24. (2006058)
WHEREAS, Miller Investments has requested approval of a PUD amendment to allow an 8,100 -square
foot daycare building for property legally described as follows:
Lot 1, Block 1, Plymouth Station, Hennepin County, Minnesota described as follows:
Commencing at the southeast corner of said Lot 1; thence South 88 degrees 56 minutes 41
seconds West, assumed bearing along the south line of said Lot 1 a distance of 64.50 feet to the
point of beginning of the land to be described; thence North 1 degree 03 minutes 19 seconds
West 132.00 feet; thence North 68 degrees 29 minutes 19 seconds West 21.00 feet; thence
North 21 degrees 52 minutes 19 seconds West 73.00 feet; thence North 86 degrees 08 minutes
19 seconds West 217.00 feet; thence South 18 degrees 00 minutes 21 seconds West 205.67 feet
to said south lone of Lot 1; thence easterly along said south line 245.07 feet being a
nontangential curve concave to the north having a radius of 918.51 feet, a central angle of 15
degrees 17 minutes 14 seconds and a chord that bears South 83 degrees 24 minutes 41 seconds
East; thence continuing along said south line tangent to said curve North 88 degrees 56 minutes
41 seconds East a distance of 86.53 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and
recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Miller Investments
to allow an 8,100 -square foot daycare on property located at 16605 County Road 24, subject to the
following findings and conditions:

1. A PUD amendment is granted to allow an 8,100 square foot daycare, in accordance with the
application and plans received by the City on June 30, 2006 and additional materials received on
August 4, 2006, except as may be amended by this resolution.
2. This approval includes an amendment to the master sign plan that would allow wall signage on the
west side of the building instead of the north side. No wall signage shall be permitted on the north
side. No other requirements of the master sign plan are affected by this amendment.
3. With respect to the exterior building elevation, the architectural details and color scheme shall be
finalized with the PUD final plan. The building materials will be required to match the existing
building materials used in this PUD.
4. The daycare shall be restricted to the following hours of operation: 5 am to 10 pm, Monday through
Sunday. Between the hours of 10 pm to the following 5 am, all parking lot lights on the day care
property shall be turned off and all lights shall be motion sensitive on the south side of the building.
5. Building permits are required prior to the commencement of any construction related to the
proiect and separate approval of a PUD Final Plan is required prior to issuance of any
permits.
6. As part of the materials submitted for the PUD Final Plan or prior to issuance of a building
permit, the plans shall be revised consistent with the approved PUD, the Zoning Ordinance, City
Code or the Engineering Guidelines (as may be applicable) and as follows:
a. Add eight overstory trees to the landscaping plan. Further, the additional overstory trees shall
be added to the berm to reduce visibility of the parking lot as viewed by the neighbors to the
south.
b. Revise the lighting plan to 1) remove 366 watts from the plan; 2) install side shields on the
fixtures in the parking lot and wall fixtures on the east, west and south sides of the building, 3)
reduce the wattage in each of the decorative wall fixtures at the main entry to no more than 55
watts, and 4) all lighting on the south side of the building shall be motion sensitive.
c. Identify the watermain size.
d. Add fire lane signs and the fire lane sign detail in approved locations.
e. Add the fire lane constriction detail.
f. Indicate that B612 curb and gutter will be used within the parking lot.
g. Indicate the type of material for the sewer and water service.
h. Add an approved Best Management Practice to the plans to improve the quality of surface water
runoff.
i. Indicate the type of storm sewer casting.
j. Submit copies of the following permits: Minnehaha Creek Watershed District, Hennepin County
Health Department, and MCES.
k. Pay the park dedication fee in lieu of land dedication must be paid, based on the dedication
ordinance in effect at the time the building permit is requested.

1. Execute a site improvement performance agreement and submit financial guarantee pursuant to
Section 21045.10 of the Zoning Ordinance.
7. Standard Conditions:
a. All signage, other than the exception noted above, shall comply with the Section 21155 of the
Zoning Ordinance and the approved sign plan for the Plymouth Station PUD.
b. The building shall be completely protected by a city -approved, monitored, automatic fire
sprinkler system.
c. Transformers and other ground equipment shall be screened with shrubs.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof
shall be grounds for revocation.
h. This approval shall expire one year after the date of approval, unless the property owner or
applicant has substantially started constriction of the project, or unless the landowner or
applicant has received prior approval from the City to extend the expiration date for up to one
additional year, as regulated under Sections 21045.09 of the Zoning Ordinance.
