HomeMy WebLinkAboutCity Council Resolution 2006-356CITY OF PLYMOUTH RESOLUTION NO. 2006-356 AUTHORIZING THE VACATION OF A PORTION OF DRAINAGE, UTILITY AND PONDING EASEMENTS WITHIN LOT 1, BLOCK 1, ELWELL MILEY AND QUINN ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for September 12, 2006 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of September 12, 2006; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the Council did hold a public hearing on September 12, 2006 to inform any and all interested parties relevant to the vacation of drainage, utility and ponding easements within Elwell Miley and Quinn Addition; and WHEREAS, it was determined by the City Council that said easements were not needed for public purposes; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following drainage, utility and ponding easements be vacated: That portion of a drainage, utility, and ponding easement filed as Document No. 2743012 described as that part of Lot 1, Block 1, Elwell Miley and Quinn Addition, Hennepin County, Minnesota, according to the recorded plat thereof which is described as Beginning at the Northeast corner of said Lot 1; thence on an assumed bearing of South 16 degrees 04 minutes 38 seconds West a distance of 225.00 feet along the Easterly line of said Lot 1; thence North 73 degrees 55 minutes 22 seconds West a distance of 100.00 feet; thence North 16 degrees 04 minutes 38 seconds East a distance of 44.00 feet; Resolution No. 2006-356 Page 2 thence North 35 degrees 23 minutes 37 seconds East a distance of 179.29 feet to the northerly line of said Lot 1; thence North 89 degrees 54 minutes 24 seconds East a distance of 42.37 feet along the northerly line of said Lot 1 to the point of beginning. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
