RESOLUTION NO. 2006-354
AUTHORIZING THE VACATION OF
DRAINAGE, UTILITY AND PONDING EASEMENTS WITHIN LOT 1, BLOCK 1,
NORTHWEST BUSINESS CAMPUS 4TH ADDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for September 12, 2006 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of September 12, 2006; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on September 12, 2006 to inform any and all
interested parties relevant to the vacation of the drainage, utility and ponding easements within
Northwest Business Campus 4th Addition; and
WHEREAS, it was determined by the City Council that said easements are not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage, utility and ponding easements be vacated:
All of the existing drainage easements for ponding purposes and all of the utility and drainage
easements dedicated in
(a) the recorded plat of Northwest Business Campus (as partially vacated as evidenced
by Resolution No. 83-625, filed as Document No. 1551112), and
(b) dedicated in the recorded plat of Northwest Business Campus 4th Addition,
lying within Lot 1, Block 1, Northwest Business Campus 4th Addition, except that part lying
Southeasterly of the following -described line: Beginning at a point in the Southwesterly line of said
Lot 1 distant 10 feet Northwesterly of the most Southerly corner thereof, thence run Northeasterly to a

point on the Southeasterly line of said Lot I distant 53.79 feet Northeasterly of said most Southerly
corner as measured along said Southeasterly line and there terminating.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
