HomeMy WebLinkAboutCity Council Resolution 2006-343CITY OF PLYMOUTH RESOLUTION 2006-343 APPROVING A SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AND VARIANCE TO ALLOW AN ACCESSORY CARWASH ADDITION AND RELATED IMPROVEMENTS TO THE HOLIDAY STATIONSTORE AT 9705 SCHMIDT LAKE ROAD (2006072) WHEREAS, Holiday Companies has requested approval of a site plan amendment, conditional use permit and variance for an accessory carwash addition and related improvements for the Holiday Stationstore, for property legally described as: Lot 1, Block 1, Epiphany Second Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Holiday Companies for a site plan amendment, conditional use permit and variance for an accessory carwash addition and related improvements for property located at 9705 Schmidt Lake Road, subject to the following conditions: 1. A site plan amendment is approved to allow constriction of an accessory carwash, in accordance with the application materials received by the City on July 27, 2006 and August I and 25, 2006, except as amended by this resolution. 2. A conditional use permit is approved to allow an accessory carwash, based on the finding that the standards listed in the Zoning Ordinance have been met, subject to the conditions listed in this resolution. 3. A variance is approved to allow a building to drive -aisle setback of three feet on the east side, based on the following findings: Resolution 2006-343 File No. 2006072 Page 2 a. The hardship is related to the shared circulation and coordinated development for the Holiday Stationstore and the office buildings to the east (currently under constriction). When the property originally developed, the developer proposed the shared access to the properties in order to accommodate the grades and keep the properties' access point as far from the entrance to Highway 169 as possible. Because of the requirement that accessory carwashes be attached to principal buildings, there are no other potential conforming locations on this site. b. The conditions of shared development are challenging to the site and not generally applicable to other commercial properties zoned C-3. c. The variance would allow a reasonable use of the land and would not be detrimental to the public welfare or injurious to other land or property values in the neighborhood. It would also not impair an adequate supply of light and air to adjacent property or increase the congestion of the public streets. d. The request is the minimum action necessary to eliminate the hardship. 4. A building permit is required prior to construction of any improvements related to the rp olect. 5. Prior to issuance of a building permit, the plans shall be revised to meet the requirements of the Zoning Ordinance and engineering guidelines, as follows: a. Execute a site improvement performance agreement and submit the required financial guarantees pursuant to Section 21045.10 of the Zoning Ordinance. b. Submit a revised certified survey for the property showing the adjusted lot line and all existing and proposed strictures. c. Revise the lighting plan to be consistent with the requirements of Section 21105.06. d. Revise the plans to indicate that the trash room door shall be painted to match the darker color of the rock face block stripe. e. Revise the plans to show the parking area setback a minimum of ten feet from all portions of the building. f. Revise the plan to include a ten -foot bituminous trail constricted from the shared driveway to the east property line. g. Submit a noise study showing consistency with Chapter 2025 of City Code (Noise). h. Submit proof of permit issuance from the MPCA. i. Revise the plans to indicate a three-foot sidewalk located between the building and the easterly shared drive. j. Submit cross parking, access and water supply easements. k. Submit a six-foot drainage and utility easement over the new location of the property line and vacate the existing easements. 1. Revise the plans to include fire lane signs in approved locations. m. Indicate 136/12 curb and gutter to be used to protect all new drive aisles and parking areas and include detail STRT-1. n. Install silt fencing on-site. All such fencing shall require inspection and approval by City staff. Resolution 2006-343 File No. 2006072 Page 3 o. Revise the plans to include updated City details per the Engineering Guidelines dated March, 2006. p. Revise the plans to show a sanitary sewer drain inside the car wash to which all drainage is directed. Additionally, a flammable separator and a sand (grit) collection chamber are required. Provide details on the plans. q. Submit any applicable Sewer Availability Charges. r. Revise the plans to indicate that the storm sewer shall be RCP, not HDPE. s. Provide clear information on whether existing storm sewer will be removed, or remain in place. t. Provide a casting schedule. u. The storm sewer located to the south shall be consolidated into one pipe. v. Revise the plans to include the location of storm sewer inlet protection and include City details ST -22 and 23. w. Revise the plans to include City detail STRT-2. Specify amounts and type of asphalt, aggregate, and granular consistent with the detail. The drive aisle shall be constricted to a 7 -ton minimum design standard. 7. Standard Conditions: a. The addition shall be protected by the existing fire sprinkler system. An approved solenoid device is required to be connected between the fire sprinkler system and the site domestic water supply. b. All signage shall comply with the Section 21155 of the Zoning Ordinance. c. Prior to the release of any financial guarantees or issuance of a certificate of occupancy, the applicant shall submit a reproducible (8'/2" x 11") site/building "as built" fire protection plan. d. Access to fire lanes, hydrants and the building's fire alarms and sprinkler systems is required to be maintained during demolition and throughout the constriction of the project. e. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. f. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire four years after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21015.07, 21030.06 and 21045.09, of the Zoning Ordinance.
