APPROVING A SITE PLAN AMENDMENT AND INTERIM USE PERMIT FOR OPUS
NORTHWEST LLC, FOR AGA MEDICAL CORPORATION LOCATED AT 5050 NATHAN
LANE (2006061)
WHEREAS, Opus Northwest LLC, has requested approval of a site plan amendment and interim
use permit for AGA Medical Corporation, located on property legally described as Lot 1, Block
1, and Outlot A, Northwestern Bell Plymouth Office I" Addition, according to the recorded plat
thereof, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus
Northwest LLC, for a site plan amendment and interim use permit for property located at 5050
Nathan Lane, subject to the following conditions:
A site plan amendment and interim use permit to allow reduced parking are hereby approved,
in accordance with the plans received by the City on July 31, 2006, except as may be
amended by this resolution.
2. The interim use permit for reduced parking allows 279 parking spaces, where the previously
approved interim use permit requires 512 spaces, based on the finding that the applicable
interim use standards have been met.
The interim use permit for reduced parking shall expire if and when the City determines that
there is a parking shortage on the site. At such time, the landowner shall obtain the
appropriate approvals and constrict additional parking spaces on the site in compliance with
the Zoning Ordinance requirement or an amended interim use permit for reduced parking.

4. The applicant shall obtain the appropriate grading permit from the Building Division prior to
commencement of the project.
5. Prior to issuance of the trading permit, the applicant shall:
a. submit the required Site Performance Improvement Agreement and related financial
guarantee.
b. obtain the appropriate permits or approvals from Bassett Creels Watershed, City of
Plymouth (right-of-way), and NPDES.
6. Prior to issuance of the 2radin2 permit, the applicant shall address the following
Engineering Division related requirements:
a. Place a note on the plans for the contractor to contact the street supervisor, Gary Smith at
763-509-5993 at least 48 hours prior to working in the street right of way.
b. Provide updated City details from the Engineering Guidelines.
c. Provide a rock constriction entrance. Show location and include updated City detail
DWG -10.
d. Show location of storm sewer inlet protection. Include City details ST -22 and 23.
e. Provide "beehive" manhole covers for the existing storm catch basins to remain in the
reclaimed areas.
f. The plans must be signed by a landscape architect or civil engineer.
g. Identify the limits of constriction / parking lot removal.
h. Place a note on the plans that the street must be swept a minimum of once per week.
7. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
8. The approval is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
9. Standard Conditions:
a. The applicant shall submit an 8 1/2 x I I inch "As Built" Fire Protection Plan prior to the
release or reduction of any site improvement financial guarantee.
b. This site plan amendment approval shall expire one year after the date of approval, unless
the property owner or applicant has substantially started constriction of the project, or
unless the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Section 21045.09 of the
Zoning Ordinance.
