HomeMy WebLinkAboutCity Council Resolution 2006-338CITY OF PLYMOUTH RESOLUTION 2006-338 APPROVING FINDINGS OF FACT FOR REZONING OF PROPERTY PRESENTLY ADDRESSED AS 14860 COUNTY ROAD 47 (2006057) WHEREAS, Lennar Company (d/b/a U.S. Home Corporation) has requested reclassification of the zoning from FRD (Future Restricted Development) to RSF-2 (Single Family Detached 2) for roughly 5.2 acres legally described as follows: The North 353.87 feet of that part of the West half of the Northeast Quarter of Section 4, Township 118 North, Range 22 West of the Fifth Principal Meridian, lying North of the centerline of County Road 47, except the West 675.10 feet thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected property from FRD (Future Restricted Development) to RSF-2 (Single Family Detached 2). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD (Future Restricted Development) to RSF-2 (Single Family Detached 2) for the roughly 5.2 -acre site presently addressed as 14860 County Road 47, based on the following findings: 1. The proposed RSF-2 zoning classification would be consistent with the LA -2 guiding of the Comprehensive Plan. 2. All lots would comply with the lot standards specified by the RSF-2 zoning district. Resolution 2006-338 (2006057) Page 2 3. The proposed lower density is due to the required single -loaded street design that preserves and buffers the wetland. Additionally, the proposed plat would be compatible with the portion of the planned "Taryn Hills" plat abutting this site—which includes single-family development on similar -sized lots. Furthermore, had this site been included in the original "Taryn Hills" plat, the overall density for the entire development would be 3.35 dwelling units per acre—which exceeds the minimum density goal for this individual site. 4. The proposed RSF-2 zoning classification would be consistent with the zoning of surrounding properties. 5. Adequate infrastructure would be available to support RSF-2 zoning and the development proposed for this site. ADOPTED by the City Council on September 12, 2006.
