HomeMy WebLinkAboutCity Council Resolution 2006-333CITY OF PLYMOUTH RESOLUTION NO. 2006-333 IMPOSING A CIVIL PENALTY AGAINST CHILI'S SOUTHWEST GRILL AND BAR FOR LIQUOR COMPLIANCE CHECK VIOLATION WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed liquor establishments within the City; and WHEREAS, during one of these checks conducted on May 13, 2006, an individual employed at Chili's Southwest Grill and Bar, 4000 Vinewood Lane, sold an alcoholic beverage to an underage person; and WHEREAS, that individual has appeared in Hennepin County District Court and been found guilty of this violation; and WHEREAS, this establishment had two previous compliance check violations which occurred on November 7, 2003 and March 28, 2006, which is within the three year period the ordinance requires making this the third violation at this establishment; and WHEREAS, Minnesota State Statute and Plymouth City Code allow for administrative civil penalties against the license holders for such violations, NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the City Council imposes a civil penalty against Chili's Southwest Grill and Bar for: Imposition of a $2,000 fine and a 15 -day license suspension for a third violation. Impose the five days stayed from the second violation. Adopted by the City Council on August 22, 2006.
