RESOLUTION 2006-324
APPROVING A SITE PLAN AND CONDITIONAL USE PERMIT FOR OPUS NORTHWEST
LLC, TO ALLOW CONSTRUCTION OF A NEW CORPORATE HEADQUARTERS FOR
SELECT COMFORT, FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF
HIGHWAY 169 AND BASS LAKE ROAD (2006056)
WHEREAS, Opus Northwest, LLC has requested approval of a site plan and conditional use
permit for a new office building for the 15.9 -acre parcel located at the northwest corner of
Highway 169 and Bass Lake Road, legally described as follows:
Lot 2, Block 1, Bass Creels Business Park 4th Addition, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing,
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Opus
Northwest, LLC for a site plan and conditional use permit for the 15.9 -acre parcel located at the
northwest corner of Highway 169 and Bass Lake Road, subject to the following conditions:
1. The site plan to allow constriction of a 167,486 square foot building and the conditional use
permit to allow increased building height are hereby approved, in accordance with the plans
received by the City on August 1, 2006, except as may be amended by this resolution.
2. The conditional use permit allows the building height to be increased from 45 feet to 61.4
feet, based on the finding that the specific standards and all applicable general conditional
use standards have been met.
3. Prior to issuance of building permits, the following items shall be completed:
a. The applicant shall submit the required Financial Guarantee and Site Improvement
Performance Agreement.

b. the applicant shall pay the park dedication fee in lieu of land dedication, in accordance
with the Dedication Ordinance in effect at the time of building permit issuance.
c. the appropriate licensed professional responsible for the plans shall sign the civil and
architectural plans.
d. the applicant shall provide an easement to provide unobstructed access from 59t1' Avenue
to the storm sewer outfall. The access easement area shall be a minimum of 15 feet wide
and shall not exceed a 15 percent grade.
e. A maintenance agreement for the storm sewer sump manholes shall be provided.
4. Prior to issuance of building permits, the following revisions shall be made to the plans:
a. specify B612 concrete curb and gutter.
b. include additional directional flow arrows on the grading plan; identify overland
emergency overland overflows, and elevations.
c. note on the plan the emergency overflow location and elevation for the lower parking lot;
there shall be a minimum of 18 inches of freeboard.
d. include the names and contact numbers for the responsible parties on the SWPPP (Storm
Water Pollution Prevention Plan), page C7.1.
e. add a note to the plans that retaining walls may be required on the 2:1 slope if substantial
vegetation is not achieved.
5. Fire Division requirements:
a. the site watermain system shall be looped.
b. add and relocate hydrants and fire lane signage, as required by the Fire Inspector.
c. submit turning radius evaluations on all fire lanes identified on Plan A1.1.
d. the parking ramp shall include a dry standpipe system.
6. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the
State Plumbing Code, whichever applies.
7. The developer shall obtain the necessary permits and approvals as follows: Shingle Creek
Watershed Management Organization, Wetland Conservation Act, Minnesota Department of
Health for watermains, MCES for sanitary sewer connection (private), plumbing and
building permit from the City of Plymouth Building Division, City of Plymouth Engineering
Division to work in street right of way, and NPDES.
8. Rooftop equipment shall be screened in compliance with the Zoning Ordinance.
9. Trash and recycling storage shall be in compliance with the Zoning Ordinance.
10. Any signage shall be in compliance with the City's sign regulations, and shall receive prior
approval of the appropriate sign permit.

11. Prior to issuance of the certificate of occupancy, a Transportation Demand Management
(TDM) Program shall be submitted for staff review and approval.
12. Standard Conditions:
a. The applicant shall submit an 8 1/2 x I I inch "As Built" Fire Protection Plan prior to the
release or reduction of any site improvement financial guarantee.
b. This site plan approval and conditional use permit shall expire one year after the date of
approval, unless the property owner or applicant has substantially started constriction of
the project, or unless the landowner or applicant has received prior approval from the
City to extend the expiration date for up to one additional year, as regulated under
Sections 21045.09 and 21015.07, respectively, of the Zoning Ordinance.
