FOR "FOUR POINTS OF PLYMOUTH", TO CREATE FOUR LOTS ON PROPERTY LOCATED AT 15910 AND 16000 OLD ROCKFORD ROAD (2006022F) WHEREAS, CBR Development, LLC. has requested approval of a final plat for "Four Points of Plymouth", a plat to create four lots for single-family dwellings on two acres located at the 15910 and 16000 Old Rockford Road; and WHEREAS, the property is legally described as follows: (TORRENS) That part of the Southeast Quarter of the Northeast Quarter, Section 17, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at a point on the East line of said Southeast Quarter of the Northeast Quarter distant 78.80 feet South from the Northeast corner of said Southeast Quarter of the Northeast Quarter; thence North to said Northeast corner; thence West along the North line of said Southeast Quarter of the Northeast Quarter, a distance of 436.60 feet; thence Southerly, deflecting to the left 93 degrees 41 minutes to the line designated as survey line on HENNEPIN COUNTY STATE AID HIGHWAY NO. 9, PLAT 9; thence Easterly along said survey line to the West line of the East 143.00 feet of said Southeast Quarter of the Northeast Quarter; thence North along said West line to a line drawn West, parallel with the North line of the Northeast Quarter of said Section 17, from the point of beginning; thence East along said parallel line to the point of beginning. And Resolution 2006-319 Final Plat (2006022F) Page 2 (ABSTRACT) That part of the Southeast Quarter of the Northeast Quarter, Section 17, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Commencing at a point on the East line of said Quarter -Quarter at the intersection of the center line of County Road No. 9; thence north 168 feet; thence West parallel with the North line of said Section 17, a distance of 143 feet; thence South parallel with the East line of said Section to a point in the center line of said County Road No. 9 (formerly State Highway No. 55 and also known as Rockford Road); thence East along center line of County Road No. 9 to a point of beginning. and That part of the Southeast Quarter of the Northeast Quarter of Section 17, Township 118, Range 22, Hennepin County, Minnesota, described as follows: Beginning at a point on the East line of said Southeast Quarter of the Northeast Quarter distant 78.80 feet South from the Northeast corner of said Southeast Quarter of the Northeast Quarter; thence Southerly to a point on said East line, distant 168.00 feet North of the intersection of the line designated as the survey line on Hennepin County State Aid Highway No. 9, Plat 9 and the said East line of the Southeast Quarter of the Northeast Quarter; thence Westerly, parallel with the North line of the Northeast Quarter of said Section 17, a distance of 143.00 feet; thence Southerly, parallel with said East line of the Southeast Quarter of the Northeast Quarter to said survey line; thence Westerly along said survey line to the West line of the East 143.00 feet of said Southeast Quarter of the Northeast Quarter; thence Northerly along said West line of the East 143.00 feet to the intersection with a line drawn Westerly parallel with said North line of the Northeast Quarter from the point of beginning; thence Easterly along said parallel line to the point of beginning. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CBR Development, LLC. for a final plat; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: Resolution 2006-319 Final Plat (2006022F) Page 3 1. Approval of the final plat is contingent upon the applicant executing the Development Contract. 2. This final plat approves four lots for single-family dwellings, in accordance with the plans received by the City on July 21 and 28, 2006 and August 7, 2006, except as amended by this Resolution. 3. This approval waives the requirement for sidewalks to be installed on Weston Lane. 4. Prior to recording the final plat, the applicant shall remove the existing strictures, accessory buildings, retaining walls and the driveways accessing Vicksburg Lane and Old Rockford Road. Separate permits are required for these activities. 5. Prior to approval of any 2radin2 permits or recording the final plat, the applicant shall revise the plans in conformance with City Code and/or the Engineering Guidelines (updated March 2006) or provide the necessary information as follows: a. Revise the grading/tree preservation plan to show tree preservation fencing around trees 13 and 14 and 28-30. b. Obtain the following necessary permits and approvals: MPCA, Minnesota Department of Health, Bassett Creek Watershed Management Commission, Hennepin County, NPDES and City of Plymouth street right-of-way permit. c. Submit written consent from any affected property owners for off-site disturbance. d. Revise the lowest floor elevations on the final plan as follows: Lot 3 = 981.8, Lot 4 = 975.0. Additionally, the lowest elevation for the lowest opening shall be at least 1.5 feet above the overland flow. e. Identify the size of the water services. f. Provide drainage details around the garage located on the property to the west. g. Provide topography 100 feet west of the plat boundary. h. Remove the retaining walls from the drainage and utility easement. i. Provide a detail showing there will be adequate site distance at Vicksburg Lane and Old Rockford Road. j. Revise utility note 10 on page 3 to indicate that 410 gauge solid copper insulated tracer wire is required for the watermain. Also add "and gate valves where required" after break off flanges. k. Remove the trash guard from the 15 inch RCP FES on page 3, and add a note to tie all joints from MH 1 to the FES. 1. Revise note 4 on page 3 to "tie the last 6 joints or as noted on the plans". m. Revise the storm sewer casting schedule to indicate a 48 inch minimum stricture size for CB 1. Also identify that Neenah casting R-4342 is with a concrete frame. n. Show the emergency storm water overflow for Weston Lane. o. Provide a cross section of the infiltration basin and label the area around CB 1 as an additional best management practice (BMP) to accommodate the first flush of rainfall. Resolution 2006-319 Final Plat (2006022F) Page 4 Existing clay material shall be removed and replaced with sand. Filter fabric, 4 inches of black dirt and sod shall be placed on top. p. Remove the outlet control stricture to the right of City detail ST -15 on the detail page and provide site specific elevations to ST -15. q. Revise the landscaping plan to remove plantings within ten feet of underground City utilities and as may be necessary to provide a 15 -foot unobstructed access to the water quality pond's inlet and outlet. r. Install tree preservation and erosion control fencing and such fencing shall be inspected and approved by City staff. s. Provide the following easements: 1) On the final plat: Standard drainage and utility easements: a 10 -foot wide drainage and utility easement adjacent to all street right-of-ways, a 6 -foot wide easement for all side and rear property lines, and an easement over water -quality ponds, and rain gardens from the OHWL. Additional right-of-way: a total of 45 feet from centerline of Old Rockford Road and a total of 60 feet from centerline of Vicksburg Lane. 2) Separate Documents: An access easement 15 -foot wide for maintenance to the N[_]RP pond (including inlet and outlet) and rain garden. (The grade in the access area shall not exceed 15 percent and no plantings are permitted in the area.) A drainage and utility easement for the emergency overflow from the water quality pond. (This easement must be acquired from all affected private property owners. If the easement is not received, the applicant must find an alternate emergency overflow route.) 6. Prior to issuance of a building permit, the applicant shall: a. Remove the temporary turnaround on Lot 2, Block 3 Northfork addition and restore the area with sod. The resulting driveway shall meet the required 24 -foot maximum width at the public right-of-way as specified in the Zoning Ordinance. b. Record at Hennepin County and provide proof of recording for the final plat, resolution, and all separate easements. 7. The applicant shall repair any damage to the trails in Vicksburg Lane and shall not park equipment on any portion of the trail during constriction or use the trail to access the property. 8. Development standards shall be as required by the RSF-2 zoning district. No variances are granted or implied. 9. Each lot shall be limited to 25 percent impervious surface coverage and the total amount of impervious surface coverage proposed on each lot shall be submitted with any request for a building permit. 10. Standard Conditions: a. All hazardous trees shall be removed from the property at the owner's expense. Resolution 2006-319 Final Plat (2006022F) Page 5 b. Park dedication shall be paid prior to the recording the final plat. The fees shall be calculated based on the adopted rates at that time. c. No retaining walls shall be located within any right-of-way or drainage and utility easement. Any wall over four feet in height requires a separate building permit and a three-foot fence installed on top. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
