RESOLUTION 2006-313
RESOLUTION REVOKING PLAN MODIFICATION
FOR FRENCH REGIONAL PARK
WHEREAS, the City has approved a conditional use permit which includes the Master Site
Plan for French Regional Park; and
WHEREAS, the Three River Park District ("District") requested a site plan amendment to
create an off -leash dog park in French Regional Park; and
WHEREAS, on November 10, 2005, City staff approved the site plan amendment as a plan
modification; and
WHEREAS, the City Council has determined that the site plan modification does not
satisfy the criteria for approval as a plan modification because the amendment is a major
amendment involving the establishment of a 7.1 acre off -leash dog park adjacent to residential
property; and
WHEREAS, the site plan modification must be processed as a major project requiring
review by the Planning Commission and approval by the City Council; and
WHEREAS, the District also did not submit to the City an amendment to its existing
Master Site Plan as required by the 1995 Cooperative Agreement between the District and the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA:
1. The November 10, 2005 site plan amendment for French Regional Park is revoked.
2. The Three River Park District, its agents, employees, contractors and subcontractors
are directed to cease and desist from all work related to the off -leash dog park.
3. A stop work order shall be issued.
