HomeMy WebLinkAboutCity Council Resolution 2006-299CITY OF PLYMOUTH RESOLUTION 2006-299 AFFIRMING CITY STAFF'S INTERPRETATION OF THE REQUIREMENTS OF SECTION 21035 OF THE PLYMOUTH ZONING ORDINANCE, PERTAINING TO THE REQUIREMENT FOR A FINANCIAL GUARANTEE FOR THE TWIN CITY FAN AND BLOWER PROJECT, 5959 TRENTON LANE NORTH (2005142) WHEREAS, on July 18, 2006, Charles Barry appealed the requirement for a financial guarantee for Twin City Fan and Blower's project for a building addition and parking lot expansion, located on property legally described as the northerly 151.08 feet of Lot 1, Block 2 and Lot 2, Block 2, Bass Creek Business Park Addition, Hennepin County, Minnesota; and WHEREAS, when hearing an appeal, the City Council acts in its capacity as the Board of Adjustments and Appeals. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does affirm City staff s interpretation of the Plymouth Zoning Ordinance, based on the following findings and conditions: 1. City staff correctly interpreted the legislative intent of the applicable provisions of the Plymouth Zoning Ordinance relating to site improvement performance agreements and financial guarantees. 2. The owner shall submit a financial guarantee meeting the requirements of Section 21035 of the Zoning Ordinance prior to issuance of a certificate of occupancy for the building addition.
