RESOLUTION 2006-298
DENYING A PRELIMINARY PLAT AND FINAL PLAT FOR TWO
SINGLE-FAMILY LOTS TO BE KNOWN AS JIREHEL ADDITION
LOCATED AT 755 WINDEMERE DRIVE (2006029)
WHEREAS, Dmitri Smirnov and Maria Kouznetsova have requested approval of a
preliminary plat and final plat to divide the subject property into two lots for property
located at 755 Windemere Drive; and
WHEREAS, the property is legally described as follows:
Lot 7, Block =l, Gleanloch Second Addition; and
That part of Outlot B, Gleanloch Second Addition, lying easterly of a line which
passes through the southwest corner of Lot 7, Block =l, said Gleanloch Second
Addition and is perpendicular to the north line of said Outlot B and lying 1resterly of
a line which passes through the southeast corner of said Lot 7 and is perpendicular
to the north line of said Outlot B, Lot 7, Block =l, Gleanloch Second Addition
(` ,Subject Property').
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does deny the
request by Dmitri Smirnov and Maria Kouznetsova for a preliminary plat and final plat for
two single-family lots know as Jirehel Addition located at 755 Windemere Drive, based
upon the following fmdings:
1. The proposed plat would divide one existing lot with an existing home into
two lots to allow construction of an additional home. The lot on which a new home could
be constructed will be referred to as the "new lot".
2. The new lot fronts on 6th Avenue. 6th Avenue is a minor collector roadway
and currently carries 1,250 vehicle trips per day in front of the new lot.
3. There is a large earthen berm along the front of the lot that runs the length of
the block from Sycamore and Pineview. Because of the berm and the elevation of the rest
of the lot a driveway could only be constructed to serve the new lot by excavating out a
portion in the berm and constructing retaining walls. The retaining walls would result in a
"blind" driveway. Vehicles leaving the driveway would have obscured visibility of traffic

on 6th Avenue and traffic on 6th Avenue would have obscured vision of vehicles leaving the
driveway. This would be a traffic safety hazard.
4. The Subject Property is zoned RSF-1, Residential Single Family. The
minimum lot width in the RSF-1 district is 110 feet. The lot width of the proposed new lot
is 66 feet and therefore does not meet ordinance requirements. The lot width variance
granted in 1985 for Lot 7, Block 4, Gleanloch Second Addition was for one lot, not two lots,
and therefore does not apply to the proposed subdivision.
5. The proposed subdivision is located in a fully developed neighborhood. The
new lot would result in a home being constructed between the backyards of two existing
homes. The proposed subdivision is inconsistent and incompatible with the existing
development pattern and would interfere with the privacy rights and expectations of the
residents of the existing homes.
6. Outlot B of Gleanloch Second Addition was previously owned by the City.
In 1988 the City approved a lot consolidation dividing the outlot into eight segments and
combining it with the abutting lots. The land was transferred to abutting property owners
without cost. The transfer was made subject to the condition that the land not be further
subdivided and that there be no vehicle access to 6th Avenue.
