HomeMy WebLinkAboutCity Council Resolution 2006-297CITY OF PLYMOUTH RESOLUTION 2006-297 AFFIRMING CITY STAFF'S INTERPRETATION OF THE CITY'S TREE PRESERVATION REGULATIONS IN SECTION 530 OF THE PLYMOUTH CITY CODE, PERTAINING TO AN APPEAL OF A TREE FINE BY RICHARD ELSEN CONSTRUCTION, INC. FOR MEDICINE LAKEVIEW ESTATES (2005051) WHEREAS, on June 29, 2006, Richard Elsen Constriction, Inc. requested an appeal of a $7,050 tree fine for "Medicine Lakeview Estates"; for property legally described as Lots 1 and 2, Block 1, Medicine Lakeview Estates, Hennepin County, Minnesota. WHEREAS, when hearing an appeal, the City Council acts in its capacity as the Board of Adjustments and Appeals. NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does affirm City staff s interpretation of the Plymouth City Code for Richard Elsen Constriction, Inc. for "Medicine Lakeview Estates", subject to the following findings and conditions: 1. City staff correctly interpreted the legislative intent the of the applicable provisions of the Plymouth City Code relating to the tree fine. 2. Prior to the issuance of any building permits within the Medicine Lakeview Estates subdivision, the developer shall pay a reduced tree fine of $500 and amend the tree preservation to show the two trees north of the proposed driveway as saved.
