RESOLUTION NO. 2006-280
AUTHORIZING THE VACATION OF
A SEGMENT OF A DRAINAGE/UTILITY EASEMENT OVER
THE COMMON LOT LINE OF LOTS 2 AND 3, BLOCK 1
EPIPHANY SECOND ADDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for July 11, 2006 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of July 11, 2006; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on July 11, 2006 to inform any and all interested
parties relevant to the vacation of that portion of the drainage/utility easement over the common lot
line of said Lots 2 and 3, Block 1 in Epiphany Second Addition; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage/utility easement be vacated:
That part of Lots 2 and 3, Block 1, Epiphany Second Addition, Hennepin County, Minnesota, which
lies 6.00 either side of the following described line:

Commencing at the southeast corner of said Lot 2; thence North 09 degrees 54 minutes 33 seconds
West, an assumed bearing along the easterly line of said Lot 2, a distance of 161.18 feet to a corner of
said Lot 2; thence South 79 degrees 55 minutes 42 seconds West, a distance of 27.97 feet to the point
of beginning of the line to be described; thence continue South 79 degrees 55 minutes 42 seconds
West, a distance of 80.17 feet to a corner of said Lot 2; thence North 10 degrees 06 minutes 39 seconds
West, along the east line of said Lot 2, a distance of 188.41 feet to a corner of said Lot 2; thence on a
bearing of North, along the easterly line of said Lot 2, a distance of 78.66 feet and said line there
terminating.
The sidelines of the above described property are to be prolonged or shortened to commence at a line
drawn North 51 degrees 42 minutes 13 seconds West and South 51 degrees 42 minutes 13 seconds
East from the point of beginning.
