APPROVING AGREEMENT FOR A WINDOW -WELL ENCROACHMENT
INTO A DEDICATED DRAINAGEXTILITY EASEMENT
WITHIN LOT 2, BLOCK 1, CHRUCHILL RIDGE
3180 XANTHUS LANE
WHEREAS, J. Phillips Constriction Inc. has petitioned to constrict a window -well approximately
2 feet into a dedicated public drainage and utility easement on said Lot 2; and
WHEREAS, the encroachment agreement only permits the window -well to be constricted in
accordance to the plans and all related facilities must still meet all applicable City codes; and
WHEREAS, the property to which this encroachment agreement is granted is legally described as
Lot 2, Block 1, Churchill Ridge; and
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA, that the Mayor and City Manager are hereby authorized to sign, on
behalf of the City of Plymouth an encroachment agreement that will allow for the constriction a
window -well within the dedicated public drainage and utility easement within said lot.
