RESOLUTION NO. 2006-251
APPROVING AGREEMENT NO. PW 07-17-06
WITH HENNEPIN COUNTY FOR COUNTY
STATE AID HIGHWAY 101
COUNTY PROJECT NO. 9516
CITY PROJECT NO. 5102
WIffiREAS, the County and the City have been negotiating to bring about the reconstruction of
County State Aid Highway No. (CSAR) 101 from 147 feet south of 131h Avenue North to 75 feet
south of 30th Place North; and
WIffiREAS, the aforedescribed roadway improvements are all to be accomplished under Hennepin
County Project No. (C.P.) 9516 (State aid Project No. 27-701-13) and City Project No. 5102,
hereinafter referred to as the "Project'; and
WIffiREAS, the County is developing the detail plans for the Project and anticipates starting
constriction of same during the spring of calendar year 2008; and
WI-IEREAS, it is desirable and advantageous to begin the acquisition of the new right-of-way,
permanent easements and temporary easements necessary to complete said Project; and
WIffiREAS, the City and the County desire to establish the terms and conditions by which the
right-of-way and easements required for the Project are to be acquired, and to set forth the division
of costs of properties acquired for these purposes; and
WIffiREAS, a cooperative agreement specifying the division of project constriction costs among
the parties is normally prepared upon completion of the detail plans for a project; and
WIffiREAS, the County has not completed the detail plans for the Project and does not anticipate
completing said plans until the fall of calendar year 2007; and
WIffiREAS, the City has requested that a constriction cooperative agreement be prepared at this
time; and
WIffiREAS, the City and County therefore desire to set forth constriction costs divisions for the
Project; and
WIffiREAS, the City has indicated its willingness to participate in the right-of-way, constriction,
engineering, and maintenance costs of the project;

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA:
1. Agreement No. PW 07-17-06 is hereby approved, and the Mayor and City Manager
are authorized to sign the agreement on behalf of the City.
