RESOLUTION 2006-219
APPROVING A SITE PLAN, CONDITIONAL USE PERMIT, AND VARIANCES FOR
COMMONBOND COMM[_JNITIES, FOR VICKSBURG COMMONS TOWNHOMES FOR
PROPERTY LOCATED NORTH OF COUNTY ROAD 47 AND EAST OF VICKSBURG
LANE (2006017)
WHEREAS, CommonBond Communities has requested approval of a site plan, conditional
use permit, and variances for a 50 -unit rental townhome development for a 7 -acre site located
north of County Road 47 and east of Vicksburg Lane; and
WHEREAS, the property is legally described as Lot 1, Block 1, Taryn Hills 2"a Addition,
Hennepin County, Minnesota; and
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
CommonBond Communities for a site plan, conditional use permit, and variances for property
located north of County Road 47 and east of Vicksburg Lane, subject to the following
conditions:
1. A site plan is approved for a 50 -unit rental townhome development, in accordance with the
application and plans received by the City on March 16, 2006 and revised Plan A0.1
received by the City on March 28, 2006, except as may be amended by this resolution.
2. A conditional use permit is approved to allow more than one principal building on the lot,
with the finding that the applicable conditional use permit standards are met.

3. Variances are approved (pursuant to Plan A0.1) to reduce the distance between buildings,
to reduce parking and drive aisle setbacks, and to allow two dwelling units without an
enclosed parking space, with the finding that all applicable variance standards are met.
4. This approval is contingent upon City Council approval of the final plat, and no building
permits shall be issued until the final plat is recorded with Hennepin County.
5. Prior to issuance of building permits, the applicant shall revise the site plan to extend the
sidewalk along fiiture Shenandoah Lane southerly to the fiiture trial along County Road 47.
6. Prior to issuance of building permits, the applicant shall assess the noise situation and
incorporate whatever noise mitigation measures are necessary (e.g., extra wall insulation,
ridge vents, triple -pane windows, etc.) to ensure compliance with state noise standards.
7. Prior to issuance of building permits, the applicant shall revise the site plan to include a
fence along the top edge of the higher of the two parallel (terraced) retaining walls.
8. Prior to issuance of the certificate of occupancy, wetland buffer monumentation shall be
installed, consistent with Section 21670.07 of the Zoning Ordinance.
9. Prior to issuance of building permits, the applicant shall revise the site plan to include
"Reserved Parking" signage for the two parking spaces located northeast of the Advantage
Center, so each of the two units without enclosed parking would have one reserved
outdoor parking space.
10. The architectural design and building materials for the Advantage Center shall be
compatible with the residential buildings within the development.
11. The applicant has the option of paying off the assessments for City Project 6108 and City
Project 6123, or the applicant may continue to pay their share of these City projects
through annual payments as previously approved.
12. Prior to issuance of building permits, the following items shall be provided or shown on the
plans:
A. Watermain area charges of $21,365.66 (or as may be assessed at the option of the
applicant).
B. Sanitary sewer area charges of $5,742.10 (or as may be assessed at the option of the
applicant).
C. A separate unobstructed access easement for the inlet and outlet pipes for the water
quality pond. This easement must originate from a public road, be a minimum of 15
feet wide, and not exceed a 15 percent grade. Additionally, a 20 -foot wide drainage

and utility easement must be provided for all public utilities that are not in the public
street right of way.
D. A drainage and utility easement is required up to the 100 -year High Water Level for
ponds and wetlands.
E. The private drive shall be 24 feet wide from back -of -curb to back -of -curb.
F. The applicant shall obtain the necessary permits and approvals as follows: MPCA,
Minnesota Department of Health, Wetland Conservation Act, Elm Creek Water
District, City of Plymouth Engineering Department (for work in street right-of-way),
and NPDES.
G. B612 concrete curb and gutter is required for the bump out parking along the private
drive, and at non -driveway locations. Show locations of B612 and surmountable
curb on the plans.
H. Increased volumes of runoff due to development should be minimized by limiting
impervious cover and encouraging infiltration of storm water where soil conditions
are appropriate. Submit a description on how this is being done and show on the
grading plan.
L The City encourages the use of alternative landscape techniques and materials to
reduce rates and volumes of runoff. Submit a description on how this is being done
and show on the grading plan.
J. Proposed developments must identify all reasonable steps to avoid water quality
impacts and mitigate with appropriate best management practices (BMPs), to prevent
water quality in receiving waters from falling below established standards. Submit a
description on how this is being done and show on the grading plan.
K. The site plan shall comply with the City of Plymouth's current Engineering
Guidelines or the State Plumbing Code, whichever applies.
L. Provide current Engineering Guideline details updated in March 2006. Revise
Constriction Notes to reflect this.
M. Show the 922 contour around the water quality pond.
N. Show the emergency overflow elevation of 922.5 for the water quality pond.
O. Show locations of concrete pedestrian ramps on plan. Include City details STRT-6
and 7.
P. The sanitary sewer manhole numbers in the plan and profile do not correspond with
each other. Clarify the numbers on the plans.
Q. Show the storm sewer locations and elevations in the sanitary sewer profile.
R. Show all existing sanitary sewer pipe and manholes using dashed lines in the profile.
Add a note to the plans that existing manholes shall be core drilled.
S. Show sanitary sewer service stationing, elevations, and Wye locations. Add this
information to the plan and in the profile. Consider using a table identifying the Wye
stationing and elevation.
T. Specify on the plans that the sanitary sewer pipe shall be class SDR 26.
U. Show the plan and profile on separate pages for the Sewer and Water, and for the
Street and Storm Sewer.
V. Provide a street signage plan.

W. Specify C900 DR18 PVC watermain on the plans.
X. The twin gate valves at the intersection of street B and C are not necessary.
Y. Show doghouse locations for the multi -family strictures. Fire hydrant locations are
dependant upon the doghouse locations.
Z. Revise Landscape plan to provide for unobstructed access easements, and show no
plantings within 10 feet of each side of public utility pipes.
AA. Label all private drives and utilities on the plans as "Private".
BB. Add a note to the plan that all streets must be swept a minimum of once per week
during constriction.
CC. Indicate on the plans the locations where approved storm sewer erosion control inlet
protection will be located.
13. Standard Conditions:
A. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for
new strictures on sites adjacent to, or containing any open storm water drainage
facility.
B. Compliance with the tree preservation regulations.
C. Prior to issuance of building permits, submission of the required Financial Guarantee
and Site Performance Agreement for completion of site improvements.
D. Prior to issuance of building permits, the applicant shall provide payment of park
dedication fees -in -lieu of land dedication according to the dedication ordinance.
E. Prior to issuance of building permits, the applicant shall submit fire flow calculations
for review and approval by the Fire inspector.
F. Compliance with the ordinance regarding turning radii, and the location of fire
hydrants, fire department connections, post -indicator valves, approved solenoid
device, lock boxes, fire lanes, and fire lane signage.
G. All buildings including the Advantage Center must be protected by a city -approved
fire sprinkler system. A "doghouse" stricture (containing the fire sprinkler system
valves and riser) is required for each of the multi -family buildings.
H. The City requires reproducible mylar prints of the sanitary sewer, water service, and
storm sewer As-builts prior to releasing the financial guarantee. Additionally, a city
approved "as built' plan for the entire development, and for each building, must be
submitted to the Fire Inspector.
L Compliance with regulations regarding handicapped parking spaces and access.
J. Address/directional signage, as approved by the City, shall be required for this
development.
