FOR "PLYMOUTH CROSSROADS STATION" FOR PROPERTY LOCATED SOUTH OF HIGHWAY 55 AND EAST OF COTTONWOOD LANE (200512 1) WHEREAS, DJR Architecture, Inc. has requested approval of a PUD general plan for property currently legally described as follows: Tracts A and B, Registered Land Survey No. 1676, Hennepin County, Minnesota. Being registered land as is evidenced by Certificate of Title No. 831051. Un Resolution 2006-194 (2005121) PUD General Plan Page 3 of 8 That part of right-of-way of State Think Highway No. 55 adjoining the above described (Parcels 4 1, 2, 3, 4 and 5) lying Southwesterly of a line drawn parallel with and 70.00 feet southwesterly (as measured at right angles to) the centerline of eastbound lanes of State Think Highway No. 55. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DJR Architecture, Inc. for a PUD general plan, subject to the following conditions: 1. A PUD general plan is approved for "Plymouth Crossroads Station", in accordance with the plans received by the City on April 11, 2006, except as may be amended by this resolution. 2. Approval of the PUD general plan is contingent upon approval of the following: a. Rezoning of portions of the site from C-2 (Neighborhood Commercial), C-3 (Highway Commercial), and PUD (Planned Unit Development) to a new PUD; b. Preliminary plat for "Plymouth Crossroads Station"; c. Vacation of the existing frontage road right-of-way; and d. Wetland mitigation plan by the City Council. 3. The developer shall enlarge the culvert running under Highway 55 and through the large vacant site to provide sufficient capacity for storm water flow as it moves northerly through the site, toward Medicine Lake. Additionally, the developer shall provide an emergency overland overflow route at an elevation to ensure that drainage does not back up and flood homes along the creek located to the south. 4. The ponding system shall be designed to provide for retention and treatment of storm water runoff under filly developed conditions. The applicant shall incorporate Best Management Practices (BMP's) into the plans to be submitted in conjunction with the final plat. 5. Any fi ture development of Outlot B would require separate review and approval of a PUD general plan. The City's tree preservation regulations shall be applied separately to Outlot B. 6. Prior to issuance of any building permits, if the applicant wishes to maintain the median break near County Road 73 on the relocated frontage road as a temporary Resolution 2006-194 (2005121) PUD General Plan Page 4 of 8 condition, they shall pay all legal fees related to, and execute, a document stating that the median break would be eliminated and the median would be extended if and when County Road 73 is realigned in the future. 7. In conjunction with street constriction, the applicant shall 1) provide a sidewalk along the south side of the relocated frontage road lying between Cottonwood Lane and West Medicine Lake Drive, and 2) relocate the required trail in the east portion of the site southerly to the County Road 73/frontage road intersection. 8. Prior to issuance of any building permits, the final lighting plan shall be approved by staff, in accordance with the City's lighting regulations. The lighting plan shall indicate house -side shields and shall include information on the decorative fixtures. 9. Development standards for the PUD shall be as indicated on the plans received by the City on April 11, 2006, except as may be amended by this resolution. 10. All strictures shall comply with the following architectural design standards: a. The buildings shall be constricted in accordance with the respective building elevations received by the City on March 10, 2006. All building elevations shall receive nearly equal treatment and visual qualities. b. Building colors shall be harmonious throughout the development. Bright, long, continuous bands of color are prohibited. Bright or brilliant colors and sharply contrasting colors may be used only for accent purposes and shall not exceed five (5) percent of the wall area. c. All parapets visible from the back shall be painted to match the building. d. Any visible rooftop or ground -mounted mechanical equipment shall be screened or painted to match the building. Materials for any screening walls shall be of the same materials as the primary stricture. e. Trash and recycling storage areas shall be integral to the buildings. f. Exterior lighting shall be consistent throughout the development. Decorative light standards are to be incorporated throughout the pedestrian walkway areas. g. Elevations of all sides of a proposed building shall be submitted with the required PUD Final Plan, for determination of compliance with the above requirements. 11. The pedestrian walkway system within and through the development shall use decorative paving and shall be raised where it crosses drive aisles. 12. The use of outdoor loudspeakers shall be limited. Any outdoor loudspeaker system shall be reviewed for compliance with the City's noise ordinance. The playing of music during evening and nighttime hours shall be prohibited. Resolution 2006-194 (2005121) PUD General Plan Page 5 of 8 13. Prior to recording the final plat, cross -access and parking easements shall be recorded for this development. 14. All signage shall conform to Section 21155 of the Zoning Ordinance. 15. In conjunction with submittal of the final plat, the applicant shall revise the landscape plan to indicate a minimum height of six feet for the Black Hills Spruce trees. 16. The project shall obtain the appropriate permits or approvals from DNR, Hennepin County, MPCA, State Health Department, Wetland Conservation Act (subject to City approval), Bassett Creek Watershed, Army Corps of Engineers, Mn/DOT, and NPDES. 17. Wetland buffer signs shall be installed pursuant to City requirements. 18. The applicant shall properly address any buried trash or constriction debris found on the site. 19. In conjunction with submission of the final plat application, the plans shall be revised or information shall be provided as follows: a. Indicate the water main size on the utility plan. b. A 10 -foot drainage and utility easement is required adjacent to all street right-of- ways. c. The City will require 10 -foot utility and drainage easements on each side of a public utility where these utilities are proposed to be installed outside the right-of- way. A separate unobstructed access easement is required from a public street to all ponds inlets and outlets. The easement must not exceed 15 % grade and must be a minimum of 15 feet wide. d. Drainage and utility easements are required to the 100 year HWL for ponds and wetlands. e. The intersection for the frontage road at future County Road 73 will require a right turn lane (14' ), through lane (12' ), left turn lane (14') and inbound lane (18') along with a median (6'). f. The developer is responsible for the constriction of the necessary watermain, sanitary sewer, storm sewer and streets to service the site. g. Submit a description of how the plan would comply with the City's Water Resource Plan Policies. h. Lowest floor elevations must be a minimum of two feet above the 100 -year HWL. Also, emergency overland overflow swales must be a minimum of 18 inches below the lowest building opening where water can enter. i. Provide a wetland replacement application. Resolution 2006-194 (2005121) PUD General Plan Page 6 of 8 j. Provide preliminary utility plan information as required in Section 510 of the Plymouth City Code. k. Provide plan view and elevations to show how frontage road will work with future County Road 73. Provide contours for the County Road 73/frontage road intersection. 1. The frontage road needs to be adjusted so that it will intersect future County Road 73 at 90 degrees. m. Show parking lot elevations. Include drainage arrows. n. Attempt to increase the street grades to at least 1.5%. o. Show reinforced water quality ponds overflow, and elevation. p. Show underground sanitary sewer, storm sewer, and watermain pipes on the Landscape Plan. Keep trees and shrubs 10 feet away from each side all underground pipes. q. Keep all retaining walls out of street rights-of-way and drainage and utility easements. r. Wetland mitigation cannot be located in a street right-of-way. s. The existing sanitary sewer system shall be televised prior to any constriction. t. Add a catch basin in the northwest quadrant of West Medicine Lake Blvd./frontage road intersection, and where a storm pipe crosses a curb line. u. Access to the neighboring properties must be maintained. v. The frontage road including the connection east of Cottonwood Lane must be 36 feet wide. w. Show existing contours in Highway 55 ditch, and how ditch will drain. x. Provide commercial driveway entrances for all development entrances. y. The City will require a storm water drainage plan showing proposed finished contours indicating how the proposed plat will ultimately drain. This material must be submitted in conjunction with proposed storm sewer plans. The City will then review the proposed storm drainage plans for compliance with the City's Comprehensive Plan for Storm Drainage System. z. Provide hydrologic calculations for the 1-, 2-, 5-, 10-, 25-, and 100 -year rainfall events demonstrating compliance with City standards. Include drainage area maps depicting both on site and off site areas for pre and post drainage conditions. aa. A storm sewer drainage map with runoff calculations and pipe capacity calculations shall be fi rnished to the City prior to the final approval of the storm sewer. bb. Show N [_]RP pond outfall skimmer strictures. Include riprap overflow and elevation. cc. Show all overland emergency overflow elevations and locations, including the emergency overflow from the wetland to the north. The overflow must be at least 1.5 feet lower than the low opening of upstream strictures. Clearly label this overland emergency overflow on the grading plan. Resolution 2006-194 (2005121) PUD General Plan Page 7 of 8 dd. Indicate location and elevation where storm water will overflow Highway 55 northerly. ee. Use current City of Plymouth Engineering Guideline Details updated March 2006. ff. The drive west of future County Road 73 shall be right in right out only when the County Road 73 improvements are constricted. gg. Provide an erosion control plan that is in accordance with current Engineering Guidelines and City Standards. hh. Provide a Stormwater Sewer Pollution Prevention Plan (SWPPP) to the plans. ii. Clearly show both existing and proposed utilities. jj. Extend the proposed watermain and connect to the existing watermain in Cottonwood Lane. k k. Review comments from Hennepin County (excluding suggested median at frontage road in CR RD 73) and Mn/DOT shall be addressed. ll. Modify the turn lanes on eastbound frontage road (to northbound and southbound CR 73) to provide one northbound turn lane and one southbound turn lane. 20. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County and City staff approves the PUD final plans. b. Removal of all hazardous trees from the property at the owner's expense. c. Compliance with the Ordinance regarding turning radii, the location of fire hydrants, lock boxes, post indicator valve, fire department connection, fire lanes, and fire lane signage. d. In conjunction with submission of the final plat application, the applicant shall submit fire flow calculations. e. All strictures shall be protected by a City approved NFPA 13 automatic fire sprinkler system. f. All automatic fire sprinkler systems shall be monitored by an approved UL Central station with a UL certificate. g. Combination domestic/fire water supply lines to each building shall have an approved solenoid device. h. An 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement bonds per City Policy. A floor plan and preplan data sheet shall be provided for each building. i. Prior to issuance of building permits, the developer shall enter into a Site Improvement Performance Agreement and shall provide the required financial guarantee.
