RESOLUTION 2006-193
APPROVING A PRELIMINARY PLAT FOR DJR ARCHITECTURE, INC. FOR PROPERTY
LOCATED SOUTH OF HIGHWAY 55 AND EAST OF COTTONWOOD LANE (200512 1)
WHEREAS, DJR Architecture, Inc. has requested approval of a preliminary plat for property
currently legally described as follows:
Tracts A and B, Registered Land Survey No. 1676, Hennepin County, Minnesota. Being
registered land as is evidenced by Certificate of Title No. 831051.

That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118,
Range 22, Hennepin County, Minnesota described as beginning at the northwest corner of
Tract B, RLS No. 1676, Hennepin County, Minnesota; thence South 8 degrees 06 minutes
05 seconds West on a assumed bearing along the west line of said Tract B, a distance of
107.68 feet; thence South 89 degrees 55 minutes 05 seconds West along the northeasterly
line of Tract A, said RLS No. 1676, a distance of 100.00 feet; thence North 8 degrees 54
minutes 02 seconds East along said northeasterly line, a distance of 135.17 feet to the
southerly right-of-way line of State Think Highway No. 55 (as monumented); thence
South 74 degrees 06 minutes 45 seconds East along said right-of-way line, a distance of
97.99 feet to the point of beginning.

118, Range 22, Hennepin County, Minnesota, lying Northeasterly of the northeasterly line
of Old County Road No. 6 and Northwesterly of Naumann Cartway (per plat of Schiebe's
Highland View Addition) and Southwesterly of State Think Highway No. 55 (as
monumented).

line of Old County Road No. 6, and described as beginning at the intersection of the west
lien of said Section 36 wit the southwesterly line of Old County Road No. 6; thence
Southerly along the west line of said Section 36, a distance of 313.50 feet; thence
Northeasterly to a point on the southwesterly line of Old County Road No. 6, distant
173.00 feet southeasterly of the point of beginning; thence Northwesterly along the

a point on the southwesterly line of Old Country Road No. 6, a distance 248.00 feet
southeasterly of the intersection of said southwesterly line with the west line of said
Section 36; thence Northwesterly along the southwesterly line of Old County Road No. 6,
a distance of 75.00 feet; thence Southwesterly to a point on the west line of said Section

(Parcels 4 1, 2, 3, 4 and 5) lying Southwesterly of a line drawn parallel with and 70.00 feet
southwesterly (as measured at right angles to) the centerline of eastbound lanes of State
Think Highway No. 55.

WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DJR
Architects, Inc. for a preliminary plat, subject to the following conditions:
1. A preliminary plat is approved for "Plymouth Crossroads Station", in accordance with the
plans received by the City on April 11, 2006, except as may be amended by this resolution.
2. Approval of the preliminary plat is contingent upon approval of the following:
a. Rezoning of portions of the site from C-2 (Neighborhood Commercial), C-3 (Highway
Commercial), and PUD (Planned Unit Development) to a new PUD;
b. Mn/DOT vacation of the existing frontage road right-of-way; and
c. Wetland mitigation plan by the City Council.
3. No building permits shall be issued until the final plat is filed and recorded with Hennepin
County.
4. The developer shall obtain the appropriate permits or approvals from MnDOT, State Health
Department, Wetland Conservation Act (subject to City approval), Bassett Creek Watershed,
and NPDES.
5. Compliance with the City's tree preservation regulations. The City's tree preservation
regulations shall be applied separately to Outlot B.
6. The applicant shall submit the required utility and drainage easements as approved by the City
Engineer prior to recording the final plat.
7. Park dedication shall be a cash fee in lieu of land dedication, in accordance with the
dedication ordinance in effect at the time of issuance of the first building permit for each lot.
8. A sidewalk shall be provided along the south side of the relocated frontage road lying
between Cottonwood Lane and West Medicine Lake Drive.
9. Wetland buffer signs shall be installed pursuant to City requirements.
10. The applicant shall properly address any buried trash or constriction debris found on the site.

11. Standard Conditions:
a. Removal of all hazardous trees from the property at the owner's expense.
b. Street names shall comply with the City's street naming system.
c. The applicant shall comply with the Ordinance regarding the turning radii, location of fire
hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and
fire lane signage.
d. In conjunction with submission of the final plat application, the applicant shall submit fire
flow calculations.
e. All strictures shall be protected by a City approved NFPA 13 automatic fire sprinkler
system.
f. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees.
g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
h. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 510 of City Code.
