FOR PROPERTY LOCATED SOUTH OF HIGHWAY 55 AND EAST OF COTTONWOOD LANE (200512 1) WHEREAS, DJR Architecture, Inc. has requested approval of a preliminary plat for property currently legally described as follows: Tracts A and B, Registered Land Survey No. 1676, Hennepin County, Minnesota. Being registered land as is evidenced by Certificate of Title No. 831051. Resolution 2006-193 (2005121) Preliminary Plat Page 3 of 4 WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DJR Architects, Inc. for a preliminary plat, subject to the following conditions: 1. A preliminary plat is approved for "Plymouth Crossroads Station", in accordance with the plans received by the City on April 11, 2006, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon approval of the following: a. Rezoning of portions of the site from C-2 (Neighborhood Commercial), C-3 (Highway Commercial), and PUD (Planned Unit Development) to a new PUD; b. Mn/DOT vacation of the existing frontage road right-of-way; and c. Wetland mitigation plan by the City Council. 3. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. 4. The developer shall obtain the appropriate permits or approvals from MnDOT, State Health Department, Wetland Conservation Act (subject to City approval), Bassett Creek Watershed, and NPDES. 5. Compliance with the City's tree preservation regulations. The City's tree preservation regulations shall be applied separately to Outlot B. 6. The applicant shall submit the required utility and drainage easements as approved by the City Engineer prior to recording the final plat. 7. Park dedication shall be a cash fee in lieu of land dedication, in accordance with the dedication ordinance in effect at the time of issuance of the first building permit for each lot. 8. A sidewalk shall be provided along the south side of the relocated frontage road lying between Cottonwood Lane and West Medicine Lake Drive. 9. Wetland buffer signs shall be installed pursuant to City requirements. 10. The applicant shall properly address any buried trash or constriction debris found on the site. Resolution 2006-193 (2005121) Preliminary Plat Page 4 of 4 11. Standard Conditions: a. Removal of all hazardous trees from the property at the owner's expense. b. Street names shall comply with the City's street naming system. c. The applicant shall comply with the Ordinance regarding the turning radii, location of fire hydrants, lock boxes, post -indicator valves, fire department connections, fire lanes, and fire lane signage. d. In conjunction with submission of the final plat application, the applicant shall submit fire flow calculations. e. All strictures shall be protected by a City approved NFPA 13 automatic fire sprinkler system. f. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. g. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. h. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
