HomeMy WebLinkAboutCity Council Resolution 2006-192CITY OF PLYMOUTH RESOLUTION 2006-192 APPROVING FINDINGS OF FACT FOR REZONING OF LAND LOCATED SOUTH OF HIGHWAY 55 AND EAST OF COTTONWOOD LANE (200512 1) WHEREAS, DJR Architecture, Inc. has requested reclassification of the zoning from C-2 (Neighborhood Commercial), C-3 (Highway Commercial), and PUD (Planned Unit Development) to a new PUD (Planned Unit Development) for property currently legally described as follows: Tracts A and B, Registered Land Survey No. 1676, Hennepin County, Minnesota. Being registered land as is evidenced by Certificate of Title No. 831051. RM That part of the Southeast Quarter of the Northeast Quarter of Section 35, Township 118, Range 22, Hennepin County, Minnesota described as beginning at the northwest corner of Tract B, RLS No. 1676, Hennepin County, Minnesota; thence South 8 degrees 06 minutes 05 seconds West on a assumed bearing along the west line of said Tract B, a distance of 107.68 feet; thence South 89 degrees 55 minutes 05 seconds West along the northeasterly line of Tract A, said RLS No. 1676, a distance of 100.00 feet; thence North 8 degrees 54 minutes 02 seconds East along said northeasterly line, a distance of 135.17 feet to the southerly right-of-way line of State Think Highway No. 55 (as monumented); thence South 74 degrees 06 minutes 45 seconds East along said right-of-way line, a distance of 97.99 feet to the point of beginning. D That part of the Southwest Quarter of the Northwest Quarter of Section 36, Township 118, Range 22, Hennepin County, Minnesota, lying Southwesterly of the southwesterly line of Old County Road No. 6, and described as beginning at the intersection of the west lien of said Section 36 wit the southwesterly line of Old County Road No. 6; thence Southerly along the west line of said Section 36, a distance of 313.50 feet; thence Northeasterly to a point on the southwesterly line of Old County Road No. 6, distant 173.00 feet southeasterly of the point of beginning; thence Northwesterly along the southwesterly line of Old County Road No. 6, a distance of 173.00 feet to the point of beginning. RUED That part of right-of-way of State Think Highway No. 55 adjoining the above described (Parcels 4 1, 2, 3, 4 and 5) lying Southwesterly of a line drawn parallel with and 70.00 feet Resolution 2006-192 (2005121) Page 3 southwesterly (as measured at right angles to) the centerline of eastbound lanes of State Think Highway No. 55. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected portions of the site from C-2, C-3, and PUD to a new PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by DJR Architecture, Inc. for reclassification of the zoning from C-2, C-3, and PUD to a new PUD, based on the following findings: 1. The proposed PUD zoning would be consistent with the Comprehensive Plan and other City policies and plans. 2. The proposed PUD zoning would provide the City with a higher level of regulatory control than could be achieved under conventional zoning. 3. The development would incorporate common elements in the design and materials for buildings, as well as for landscaping and the walkway system, in order to create a unified development. 4. Adequate infrastructure is available to support the proposed development and rezoning of the development site. ADOPTED by the City Council on May 9, 2006. STATE OF MINNESOTA) COUNTY OF HENNEPIN) SS.
