RESOLUTION 2006-190
APPROVING A PUD GENERAL PLAN FOR LIFESTYLE PROPERTIES FOR SINGLE-
FAMILY AND MULTIPLE -FAMILY DWELLINGS ON PROPERTY LOCATED NEAR THE
INTERSECTION OF NATHAN LANE AND BASS LAKE ROAD (COUNTY ROAD 10)

WHEREAS, Lifestyle Properties has requested approval of a PUD general plan for property
legally described as follows:
That part of Outlot A, HICKORY HILLS VILLAS, according to the recorded plat there
of, Hennepin County, Minnesota EXCEPTING therefrom that part described as follows:
Beginning at the northeast corner of said Outlot A; thence South 00 degrees 21 minutes
23 seconds West, assumed bearing along the east line of said Outlot A, a distance of
75.14 feet; thence southeasterly along said east line and along a tangential curve, concave
to the northeast having a central angle of 20 degrees 08 minutes 52 seconds, a radius of
321.44 feet and an arc distance of 113.03 feet; thence South 19 degrees 47 minutes 29
seconds East, along said east line and tangent to said curve a distance of 50.00 feet;
thence southerly along said east line and along a tangential curve, concave to the
southwest having a central angle of 20 degrees 08 minutes 52 seconds, a radius of 241.44

of Section 1, Township 118, Range 22, Hennepin County.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Lifestyle Properties for PUD General plan, subject to the following conditions:
A PUD general plan is approved for the constriction of a 61 -unit residential development,
according to the plans received by the City on February 2 and 7, 2006 and March 22, 2006,
except as amended by this resolution.
2. Approval of this PUD general plan is contingent upon City approval of the rezoning,
preliminary plat and the wetland mitigation plan.
Development standards shall be as indicated on the plans dated March 22, 2006, except as
amended by this resolution.
4. No building permits shall be issued until a PUD final plan is submitted to and approved by
City staff
5. As part of the materials submitted for the PUD final plan, the applicant shall submit revised
elevation drawings for all multiple -family strictures and conceptual drawings for the single-
family homes showing additional fenestration or at least one feature providing greater
articulation for each side and rear elevation.
6. As part of the materials submitted for the PUD final plan, the applicant shall submit a revised
landscape plan that relocates 2-3 trees behind the single-family homes on lots 21 and 22 from
elsewhere on the plan.
7. The following structural setbacks shall apply:

a. A 25 -foot setback measured from the right-of-way of Nathan Lane, 57th Place North, and
57th Avenue North.
b. A 25 -foot rear setback.
c. A 50 -foot setback from the OHWL of Bass Creek.
d. A 15 -foot setback from the wetland buffers, except that uncovered decks and at -grade
patios may be located up to nine feet from the wetland buffer.
e. A 16 -foot setback between the living spaces of single-family homes.
f. A 12 -foot setback between garages for the single-family homes.
g. A 25 -foot setback between the sides of townhouse strictures excluding fire equipment
enclosures and at -grade patios.
h. A 40 -foot setback between the rears of townhouse strictures excluding uncovered decks
and at -grade patios.
8. The following shall not be considered encroachments into the required setbacks as long as
they do not project more than two and one-half feet into the required setback: cantilevers up
to ten feet in width, chimneys up to six feet in width, flues, leaders, sills, pilasters, lintels,
ornamental features, cornices, eaves, gutters and the like.
9. For the portion of the development within the Bass Creek Shoreland Management District,
impervious surface coverage shall be limited to a maximum of 25 percent of the total area,
excluding the public rights-of-way. The amount of impervious surface coverage allocated to
each stricture is limited to that shown on the final impervious area plan submitted as part of
the PUD final plan.
10. Prior to issuance of building permits, the applicant must install the required permanent
wetland buffer monuments pursuant to ordinance requirements and the final grading plan.
11. Standard Conditions:
a. All signage shall require separate permits and shall be in conformance with the
requirement for residential districts as defined in the Zoning Ordinance.
b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
c. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
