HomeMy WebLinkAboutCity Council Resolution 2006-188CITY OF PLYMOUTH RESOLUTION 2005-188 APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED NEAR THE SOUTHWEST CORNER OF THE INTERSECTION OF NATHAN LANE AND BASS LAKE ROAD (2006006) WHEREAS, Lifestyle Properties, has requested reclassification of the zoning from C-2, FRD and RMF -2 to the PUD for the 15.99 -acre parcel south of the creek on property located near the southwest corner of the intersection of Nathan Lane and Bass Lake Road, presently legally described as follows: That part of Outlot A, HICKORY HILLS VILLAS, according to the recorded plat there of, Hennepin County, Minnesota EXCEPTING therefrom that part described as follows: Beginning at the northeast corner of said Outlot A; thence South 00 degrees 21 minutes 23 seconds West, assumed bearing along the east line of said Outlot A, a distance of 75.14 feet; thence southeasterly along said east line and along a tangential curve, concave to the northeast having a central angle of 20 degrees 08 minutes 52 seconds, a radius of 321.44 feet and an arc distance of 113.03 feet; thence South 19 degrees 47 minutes 29 seconds East, along said east line and tangent to said curve a distance of 50.00 feet; thence southerly along said east line and along a tangential curve, concave to the southwest having a central angle of 20 degrees 08 minutes 52 seconds, a radius of 241.44 feet and an arc distance of 84.90 feet; thence South 00 degrees 21 minutes 23 seconds West, along said east line tangent to said curve a distance of 22.80 feet; thence North 72 degrees 11 minutes 08 seconds West, a distance of 152.37 feet; thence North 19 degrees 49 minutes 18 seconds West, a distance of 26.61 feet; thence North 28 degrees 17 minutes 48 seconds West, a distance of 67.34 feet; thence North 81 degrees 11 minutes 28 seconds West, a distance of 62.34 feet; thence South 58 degrees 52 minutes 54 seconds West, a distance of 22.04 feet; thence North 84 degrees 14 minutes 08 seconds West, a distance of 19.21 feet; thence North 51 degrees 01 minutes 00 seconds West, a distance of 78.12 feet; thence North 88 degrees 02 minutes 07 seconds West, a distance of 58.17 feet; thence South 36 degrees 50 minutes 54 seconds West, a distance of 25.79 feet; thence North 71 degrees 17 minutes 17 seconds West, a distance of 31.08 feet; thence South 88 degrees 40 minutes 39 seconds West, a distance of 71.33 feet; thence North 72 degrees 12 minutes 10 seconds West, a distance of 65.00 feet; thence North 11 degrees 22 minutes 13 seconds Resolution 2006-188 (2006006) Page 2 West, a distance of 87.36 feet; thence North 46 degrees 04 minutes 54 seconds West, a distance of 43.96 feet; thence South 72 degrees 30 minutes 45 seconds West, a distance of 45.78 feet; thence North 00 degrees 20 minutes 46 seconds East, a distance of 57.44 feet to a northerly line of Outlot A; thence South 89 degrees 02 minutes 28 seconds East, along said northerly line, distance of 625.29 feet to the point of beginning. And, Lot 1, Block 4 Bass Lake Villas, and, Outlot H, the Ponds at Bass Creek, and, The north 300 feet of the east 110 feet of the northwest quarter of the southwest quarter of Section 1, Township 118, Range 22, Hennepin County. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from C-2, FRD and RMF -2 to PUD (Planned Unit Development). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from C-2, FRD and RMF -2 to PUD for the 15.99 -acre parcel south of the creek on property located near the southwest corner of the intersection of Nathan Lane and Bass Lake Road, based on the following findings: 1. The development, with 4.3 units per acre meets the intent of the density range for the LA - guiding as this density is consistent with the existing adjacent land use patterns. 2. The PUD based on the RMF -2 zoning district would provide a housing type (single-family and townhouse dwellings) that is consistent with the LA -3 guiding. 3. There would be adequate transitions for the proposed development from the commercial property to the north. 4. There is adequate infrastructure to support the development. 5. The applicant would be able to provide both moderately priced dwellings and handicapped -accessible housing. ADOPTED by the City Council on May 9, 2006.
