HomeMy WebLinkAboutCity Council Resolution 2006-185CITY OF PLYMOUTH RESOLUTION 2006-185 APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR "TARYN HILLS 2N" ADDITION" FOR U.S. HOME CORPORATION, FOR 14.51 ACRES OF LAND LOCATED NORTHEAST OF COUNTY ROAD 47 AND VICKSBURG LANE (2006018-F) WHEREAS, U.S. Home Corporation has requested approval of a final plat for "Taryn Hills 2"a Addition" to allow creation of a 7.0 -acre lot for the CommonBond townhome development, replatting of outlots for future development of the neighborhood commercial site on 6.26 acres, and constriction of a new public street on 1.25 acres, for property located northeast of County Road 47 and Vicksburg Lane; and WHEREAS, the property is presently legally described as Outlot A and Outlot B, TARYN HILLS, Hennepin County, Minnesota, according to the recorded plat thereof. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by U.S. Home Corporation for a final plat for Taryn Hills 2"a Addition; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. This final plat approves one lot and two outlots, in accordance with the final plat plans received by the City on March 21, 2006, except as may be amended by this Resolution. Resolution 2006-185 (2006018) Page 2 2. Approval of this final plat is contingent upon City Council approval of the development contract for Taryn Hills 2"a Addition. 3. The developer shall obtain the necessary permits and approvals as follows: Hennepin County, MPCA, Minnesota Department of Health, DNR, MCES, Watersheds, City of Plymouth, and NPDES. 4. The developer shall notify potential buyers about future roadway expansion and improvement projects for CR 47 and Vicksburg Lane, and shall post signage on the site regarding such fiiture roadway projects. 5. Compliance with the City's tree preservation regulations, in accordance with the approved preliminary plat. 6. The developer shall include tree protection fencing on the plans for the trees to be preserved. Such fencing shall remain in place until all constriction in the area is completed. 7. Prior to occupancy, permanent wetland buffer monument signs must be installed pursuant to ordinance requirements. 8. When the site plan is submitted for fiiture development of the commercial area within the plat (Outlot A and Outlot B), appropriate land use transitions shall be provided between the commercial area and the townhomes located to the north and east. Ownership and maintenance of Outlot B shall be addressed through covenants that run with the land. 9. Prior to issuance of building permits, the eventual developers of Lot 1, Block 1, Taryn Hills 211a Addition, and of Outlots A and B of Taryn Hills 2"a Addition, shall be responsible for payment of the required park dedication fees in accordance with Section 528 of the City Code. The park dedication fee shall be calculated based on the "maximum cash payment" in effect at the time the first building permit is issued for each lot. 10. Prior to recording of the final plat, the developer shall provide the following materials or revise the final plat and plans as follows: a. An unobstructed access easement is required from 61" Avenue to the skimmer stricture for Pond 1 NW. The access must be 15 feet wide, and must not exceed a 15 percent grade. b. An unobstructed access easement is required from Shenandoah Lane to the trunk sanitary sewer. The access must be 15 feet wide, and must not exceed a 15 percent grade. Resolution 2006-185 (2006018) Page 3 C. The sanitary sewer service from MH 3 to Outlot A shall be extended to the easement line. d. Provide a detail for the type of curb and gutter to be used on 61" Ave and Shenandoah Lane. e. Show the drain tile for the catch basins on the plan sheet. f. Change the 5 foot dimension on the plans for sidewalk to 6 feet. g. Move both 12 inch valves for the service to Outlot A back to the main. The 12 inch pipe shall be extended to the easement line in Outlot A. h. Provide a storm sewer stricture/casting schedule. i. Use the City Details from the March 2006 Engineering Guidelines. j. Use detail STRT-2 for the street section. k. Provide all necessary City details for this project. 11. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new strictures on sites adjacent to, or containing any open storm water drainage facility. c. Street names shall comply with the City's street naming system. d. Any signage shall comply with the Sign Ordinance. e. Prior to recording the final plat, the developer shall receive City approval of the fire flow calculations. f. All street water mains shall be looped. g. A reproducible 8 1/2 x 11 inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any site improvement financial guarantees. h. Approval of this final plat shall expire two years from the date approved, unless the developer has recorded the final plat with Hennepin County, or unless prior to expiration, the developer submits a written request for an extension not to exceed one additional year, as regulated under Section 512 of City Code.
