RESOLUTION NO. 2006-134
ORDERING IMPROVEMENT AND PREPARATION OF
PLANS AND SPECIFICATIONS
2006 MILL AND OVERLAY PROJECT
CITY PROJECT NO. 6106
WHEREAS, the City Council adopted a resolution on the 7th day of February, 2006,
which fixed a date for a council hearing on the proposed improvement of Pineview Lane
from Schmidt Lake Road north to Northwest Boulevard and including two intersections
at Schmidt Lake Road and Fernbrook and Schmidt Lake Road and Northwest Boulevard.
Map of these areas is attached; and
WHEREAS, the mill and overlay removes and replaces the wearing course of
bituminous on the street and removal and replacement of settled, cracked or heaved
concrete curb and gutter. In addition, storm and sanitary sewer strictures will be
reparired as needed and all necessary appurtenances; and
WHEREAS, ten days mailed notice and two week published notice of the hearing was
given, and the hearing will be held thereon the 14" day of March, 2006, at which all
persons desiring to be heard will be given an opportunity to be heard thereon, and
WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes)
since the project has not been petitioned for by the benefiting owners.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of
the City of Plymouth, Minnesota:
1. Such improvement is necessary, cost-effective, and feasible as detailed
in the feasibility report.
2. Such improvement is hereby ordered as proposed in the Council
resolution adopted March 14, 2006.
3. The Plymouth Engineering Department is designated as engineer for the
improvement. They shall prepare plans and specifications for the
making of such improvement.
4. The city council declares its official intent to reimburse itself for the
costs of the improvement from the proceeds of the tax exempt bond.
