RESOLUTION NO. 2006-133
ORDERING IMPROVEMENT AND PREPARATION OF
PLANS AND SPECIFICATIONS
2006 STREET RECONSTRUCTION PROJECT
CITY PROJECT NO. 6101
WHEREAS, the City Council adopted a resolution on the 10th day of January, 2006,
which fixed a date for a council hearing on the proposed improvement of Hemlock Lane,
from Red Fox Drive in Maple Grove to the recently constricted Hemlock Lane cul-de-
sac north of 601h Avenue, the area from the Canadian Pacific Railroad to, and including,
Balsam Lane from Zachary Lane to, and including, Larch Lane and 53rd Avenue and 541h
Avenue west of Larch Lane, includiuu the adjacent cul-de-sacs, and the area south of Old
Rockford Road to, and including, 40" Avenue and from Zachary Lane to, and including,
Revere Lane; and
WHEREAS, the proposed project includes the reconstruction of streets to include
concrete curb and gutter installation and repair, storm sewer installation and repair,
roadway resurfacing and all necessary appurtenances; and
WHEREAS, ten days mailed notice and two week published notice of the hearing was
given, and the hearing will be held thereon the 14" day of March, 2006, at which all
persons desiring to be heard will be given an opportunity to be heard thereon, and
WHEREAS, ordering this improvement requires a 4/5 vote of the Council (six votes)
since the project has not been petitioned for by the benefiting owners.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plymouth City Council of
the City of Plymouth, Minnesota:
I. Such improvement is necessary, cost-effective, and feasible as detailed in the
feasibility report.
2. Such improvement is hereby ordered as proposed in the Council resolution adopted
March 14, 2006.
3. The Plymouth Engineering Department is designated as engineer for the improvement.
They shall prepare plans and specifications for the making of such improvement.
4. The city council declares its official intent to reimburse itself for the costs of the
improvement from the proceeds of the tax exempt bond.
