HomeMy WebLinkAboutCity Council Resolution 2006-114CITY OF PLYMOUTH RESOLUTION 2006-114 APPROVING A SITE PLAN AMENDMENT AND VARIANCE TO ALLOW MODIFICATIONS AND ADDITIONS TO PLYMOUTH MIDDLE SCHOOL AT 10011 36TH AVENUE NORTH (2006003) WHEREAS, Independent School District 4281 has requested approval of a site plan amendment and variance for modifications and additions to Plymouth Middle School located at 10011 36t1' Avenue North, for property legally described as: The north 10 acres of the east one-half of the west one-half, of the north one-half, of the northeast one-quarter of Section 24, Township 118, Range 22, and The west 20 acres of the northeast on -quarter, of the northeast one-quarter in Section 24, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Independent School District 4281 for a site plan amendment and variance for modifications and additions to Plymouth Middle School located at 10011 36"' Avenue North, subject to the following conditions: 1. A site plan amendment is approved to allow constriction of modifications and additions, in accordance with the application materials received by the City on January 12, 2006, and revised plans received by the City on February 10, 2006, except as amended by this resolution. 2. A variance is approved to allow a portion of the building setback 50 feet, 35 feet and 63 feet where a 75 -foot setback between the building and the property line is required in the Zoning Ordinance, based on the finding that: Resolution 2006-114 File No. 2006003 Page 2 a. The hardship is not related to a particular physical surrounding, rather the applicant has no alternatives to constrict the additions in a conforming location, and they are necessary to upgrade the existing air -handling system. b. The variance would allow a reasonable use of the land and would not be detrimental to the public welfare or injurious to other land or property values in the neighborhood. c. Granting the variation would not impair an adequate supply of light and air to adjacent property or increase the congestion of the public streets. d. The purpose of the variance is not based upon a desire to increase the value or income potential of the parcel of land. The request is proposed to provide improved air-quality within an existing public school. e. The request is the minimum action necessary to eliminate the hardship. 3. Prior to issuance of a building permit, a site improvement performance agreement and financial guarantee shall be submitted pursuant to Section 21045.10 of the Zoning Ordinance. 4. Prior to issuance of a building permit, the applicant shall submit a color sample and specifications for the metal siding proposed. 5. Prior to issuance of a building permit, provide a maintenance schedule for the storm detention vault. 6. Prior to issuance of a building permit, the plans shall be revised to meet the engineering guidelines and as follows: a. Revise the lighting plan so that all fixtures installed on the property within 300 feet of residential property shall include side -shielding as required in the Zoning Ordinance. b. Revise the landscaping plan to include 1) screening to a height of six feet between the new parking area and the adjacent residential area and 2) screening for the closest homes with direct visibility into the trash and loading area. c. Revise the fire protection plan to 1) include fire lane signs as necessary and include the standard detail, 2) indicate a solenoid valve is required on the combination line, 3) locate the fire department connections in approved locations, 4) indicate a conforming location for a lock box, and 5) include hazardous materials signage for the chemical storage room consistent with City requirements. d. Revise the details as necessary to provide a seven -ton capacity design for any disturbed portion of the fire lane. e. Revise the utility plan to show a looped water main for the hydrants. f. Remove trash guards to the inlet and outlet storm sewer pipes for the water quality pond. g. Add a casting schedule to the storm sewer schedule that is consistent with the City Engineering Guidelines. h. Add a skimmer stricture to the pond's outlet pipe. i. Provide City Detail DWG -9 for the silt fence. j. Revise the storm sewer flared end section detail to state that the last four joints on the pipe inlet and outlet shall be tied. Resolution 2006-114 File No. 2006003 Page 3 k. Add a note to the plans that phase II silt fence shall be installed on east side of the pond after it is constricted. 1. Add a signature by the Project Engineer on the civil plans. m. Provide constriction details for the relocated watermain consistent with City requirements. n. Provide B612 curb and gutter in the new parking lot and drive aisles, excluding the fire lane. 7. Prior to issuance of a building permit, all appropriate permits shall be obtained from the Bassett Creek Watershed District, NPDES, and the City of Plymouth Engineering Department to work in the street right-of-way. 8. Prior to issuance of a building permit, the applicant shall provide the following easements: a. A drainage and utility easement for the water quality pond to the overflow elevation. The easement shall also include the storm sewer pipe outfall for the water quality pond. b. A 15 -foot wide unobstructed access easement from a public street to the water treatment pond. The access must be to the pond's inlet and outlet and must not exceed a 15 percent grade. c. A 20 -foot drainage and utility easement is requied for the storm sewer outlet pipe from the water quality pond to the catch basin manhole in 36t11 Avenue. 9. Prior to issuance of a building permit, the applicant shall provide the following information to indicate compliance with the policies of the Water Resources Plan and revise the grading plan accordingly: a. Describe how the increased volumes of runoff due to development will be minimized by limiting impervious cover and encouraging infiltration. b. Describe how the application complies with the City's goal for the use of alternative landscape techniques and materials to reduce rates and volumes of runoff. c. Describe all reasonable steps proposed to be taken to avoid water quality impacts and mitigated with appropriate best management practices (BMP's) to prevent water quality in receiving waters from falling below established standards. 10. The trash removal from the enclosure and loading area on the west side of the building shall occur between the hours of 7:00 am. to 10:00 pm. 11. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. The additions shall be protected by an approved fire extinguishing system. c. All signage shall comply with the Section 21155 of the Zoning Ordinance. d. Prior to the release of any financial guarantees or issuance of a certificate of occupancy, the applicant shall submit a reproducible (81/2" x 11") site/building "as built" fire protection plan. Access to fire lanes, hydrants and the building's fire alarms and sprinkler systems is required to be maintained during demolition and throughout the constriction of the project. b. Building permits are required prior to the commencement of any constriction related to the project. c. Prior to issuance of a building permit, tree preservation and silt fence shall be installed on- site, and inspected and approved by City staff. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire four years after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 and 21030.06 of the Zoning Ordinance.
