RESOLUTION NO. 2006-089
WAIVING THE REQUIREMENT FOR A SIDEWALK FOR PROPERTY
LOCATED AT THE NORTHEAST CORNER OF THE INTERSECTION OF
28TH AVENUE NORTH AND PILGRIM LANE (2005003)
WHEREAS, Avery Homes has requested the City Council to waive the requirement in
Section 524.07 for a sidewalk for properties located at the northeast corner of the
intersection of 28th Avenue North and Pilgrim and legally described as:
Lots 4 and 5, Block 4, Ridgecrest Addition, Hennepin County, Minnesota
WHEREAS, the City approved a minor subdivision on August 9, 2005 with plans that
showed a sidewalk installed on 28th Avenue and also required a curb ramp at the west end of
the sidewalk as a condition of approval; and,
WHEREAS, on February 7, 2006, the City Council amended Section 524.07, Subd., 1 (a) to
state, "A sidewalk shall be required on one side of all local streets unless specifically waived
by the City Council."
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request
to waive the requirement for a sidewalk for Avery Homes for property located at the
northeast corner of the intersection of 28th Avenue and Pilgrim Lane, based on the finding
that there are no sidewalks in the adjacent neighborhood and adding a sidewalk for two los
would serve no fiunctional purpose.
