HomeMy WebLinkAboutCity Council Resolution 2006-088CITY OF PLYMOUTH RESOLUTION 2006-088 APPROVING FINAL PLAT AND DEVELOPMENT CONTRACT FOR "CHURCHILL RIDGE" FOR PROPERTY LOCATED AT 18820 COUNTY ROAD 24 (2004107-F) WHEREAS, Mary Weinzierl has requested approval of a final plat and development contract related to subdivision of roughly 6.4 acres of land, presently legally described as follows: That part of the Southwest Quarter of the Northwest Quarter of Section 19, Township 118, Range 22, described as follows: Beginning at a point on the South line of said Southwest Quarter of the Northwest Quarter distance 775 feet East from the Southwest corner of said Southwest Quarter of the Northwest Quarter; thence East along said South line 120 feet; thence North at a right angle, 363 feet; thence West, at a right angle, 120 feet; thence South, at a right angle 363 feet to the point of beginning. ALSO That part of the Southwest Quarter of the Northwest Quarter of Section 19, Township 118, Range 22, described as follows: Beginning at a point on the South line of said Southwest Quarter of the Northwest Quarter distant 895 feet East from the Southwest corner of said Southwest Quarter of the Northwest Quarter; thence North, at a right angle to said South line, 363 feet; thence West, at a right angle of 280 feet; thence North, at a right angle, 190 feet; thence East, at a right angle, to the East line of the West 1217.98 feet of said Southwest Quarter of the Northwest Quarter; thence South along said East line to the South line of said Southwest Quarter of the Northwest Quarter; thence West along said South line to the point of beginning. WHEREAS, the City staff has prepared a development contract covering the improvements related to said plat. Res. 2006-088 File 2004107-F Page 2 NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve a final plat for Mary Weinzierl for "Churchill Ridge", and, FURTHER, that the development contract for said plat be approved, and that the Mayor and City Manager be authorized to execute the development contract on behalf of the City; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: I. The final plat is approved for the creation of ten lots (one lot for the existing home and accessory stricture, and nine lots for new homes) in accordance with the plans received by the City on February 6, 2006, except as may be amended by this resolution. 2. Prior to recording the final plat with Hennepin County, the Development Contract shall be executed for the public and private improvements, and the required financial guarantees and fees shall be submitted. 3. Development standards shall be as required by the RSF-2 zoning district. No variances are granted or implied. 4. Park dedication shall be a cash fee in lieu of land dedication for nine dwelling units, in accordance with the dedication ordinance in effect at the time of recording of the final plat. Additionally, if and when Lot 7 (lot containing existing home and accessory stricture) is subdivided into two parcels in the fi ture, park dedication shall be a cash fee in lieu of land dedication for one additional unit at that time, in accordance with the dedication ordinance in effect at the time of such subdivision. 5. If and when Lot 7 is subdivided into two parcels in the fi ture, the parcel boundaries for both resulting parcels shall extend to Xanthus Lane North, and the lot configuration shall be established pursuant to the approved Preliminary Plat for "Churchill Ridge," as approved by City Council on November 8, 2005. 6. If and when Lot 7 is subdivided into two parcels in the fi ture, the outbuilding (accessory stricture) located in the northern portion of the lot shall be removed prior to recording such subdivision. 7. If the existing home on Lot 7 (presently addressed as 18820 County Road 24) is redeveloped with a new home at any time in the fi ture, direct driveway access to County Road 24 shall be extinguished, and the parcel shall thenceforward obtain access and addressing from the Xanthus Lane North cul-de-sac. The City Council has waived the requirement for a sidewalk on one side of the Xanthus Lane segment lying within the plat, because such a sidewalk would not connect to other sidewalks or trails. 9. Prior to issuance of any grading or building permits, the applicant shall install tree protection fencing around trees to be preserved. 10. Provide standard utility and drainage easements. A 10 -foot drainage and utility easement is required adjacent to all public roads. A six foot drainage and utility easement is required along the side and rear property lines. 11. Provide standard easements for constriction. A 20 foot unobstructed drainage and utility easement is required for all public utility pipes that are not within a public street. A 15 foot wide unobstructed access easement is required for the water quality pond and rain garden. The grade must not exceed 15 percent. 12. Provide drainage and utility easement to the high water elevation for the wetland, rain garden, and water quality pond. 13. Add the word "North" to the end of "Xanthus Lane" on the plat. 14. Minimum floor elevations shall be as follows: Lots 1 through 5 = 1014.5; and Lots 8 through 10 = 1010.5. 15. Remove the easement crossing the middle of Lot 7. 16. Sanitary sewer services must be provided with a tracer wire. 17. Add a storm water pollution prevention plan on the grading plan. 18. Expand the rain garden boundary to tie into the wetland to the south. 19. The applicant shall provide a rain garden agreement for maintenance of the rain garden. 20. The project shall comply with the City's Engineering Guidelines. 21. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County. b. Street names shall comply with the City's street naming system. Res. 2006-088 File 2004107-F Page 4 C. Any development signage shall require a separate permit and shall comply with the City's signage regulations. d. Removal of all hazardous trees from the property at the owner's expense. e. The applicant shall comply with the Ordinance regarding the location of fire hydrants. f. Prior to recording the final plat, the applicant shall receive approval of the fire flow calculations. g. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release or reduction of any financial guarantees. h. The final plat approval shall expire two years after the date of approval, unless the applicant has recorded the final plat with Hennepin County; or, unless the applicant receives prior approval to extend the expiration date for up to one additional year, as regulated under Section 512 of City Code.
