HomeMy WebLinkAboutCity Council Resolution 2006-087CITY OF PLYMOUTH RESOLUTION 2006-087 APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT AND VARIANCE TO ALLOW AN ADDITION AT PLYMOUTH PRESBYTERIAN CHURCH LOCATED AT 3755 DUNKIRK LANE NORTH (2005149) WHEREAS, Rice-Stromgren Architects has requested approval of a site plan amendment, conditional use permit amendment, and variance for a 6,550 -square foot church expansion located at 3755 Dunkirk Lane North, for property legally described as: Lot 1, Block 1 Plymouth Presbyterian Church, according to the recorded plat thereof, Hennepin County, Minnesota WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Plymouth Presbyterian Church for a site plan amendment, conditional use permit amendment, and variance for a 6,550 -square foot church expansion, subject to the following conditions: 1. A site plan amendment and conditional use permit amendment are approved to allow constriction of a 6,550 -square foot addition, in accordance with the application materials received by the City on December 15, 2005, and revised plans received by the City on January 11 and 31, 2006, except as amended by this resolution. 2. A variance is approved to allow a seven -foot setback between the building and the drive aisle near the entrance canopy where the Zoning Ordinance requires a minimum of ten feet, based on the finding that: a. The requested three-foot reduction in the setback under the canopy would allow the changes proposed to the entrance of the building and necessary improvements to the drop- Resolution 2006-087 File No. 2005149 Page 2 off area. The request balances the need for safety for those entering and exiting vehicles under the canopy with the desire to improve the appearance of the church. b. The variance would allow a reasonable use of the land and would not be detrimental to the public welfare or injurious to other land or property values in the neighborhood. c. Granting the variation would not impair an adequate supply of light and air to adjacent property or increase the congestion of the public streets. d. The purpose of the variance is not based upon a desire to increase the value or income potential of the parcel of land. The request is proposed to provide greater articulation to an existing church. e. The request is the minimum action necessary to eliminate the hardship. 3. Approval of the lighting plan is contingent on approval of the amendment of the lighting map to designate the subject property to Lighting Zone 3. 4. Prior to issuance of a building permit, a site improvement performance agreement and financial guarantee shall be submitted pursuant to Section 21045.10 of the Zoning Ordinance. 5. Prior to issuance of a building permit, the lighting plan shall be revised so that the new fixtures conform to the maximum power allowance for the site. 6. Prior to issuance of a building permit, the plans shall be revised to meet the engineering guidelines and as follows: a. Relocate the grading and all disturbance necessary to create the rain garden a minimum of 15 feet from the coniferous trees on the north side of the site. b. Show B-6/12 curbs around the new parking spaces. c. Provide a concrete outlet stricture for the rain garden. d. Indicate that the storm sewer pipe from the rain garden to the existing manhole in Dunkirk Lane shall be RCP. e. Indicate on the plans that the storm sewer manhole in Dunkirk Lane shall be core drilled. f. Provide a 10 -foot horizontal separation between the watermain and the 8" HDPE pipe. g. The draintile upstream from the rain garden may be four inches in diameter. 7. Prior to issuance of a building permit, the applicant shall submit fire flow calculations consistent with City requirements. 8. Prior to issuance of a building permit, all appropriate permits shall be obtained from the Minnehaha Creek Watershed District, NPDES, and the City of Plymouth Engineering Department to work in the street right-of-way. 9. Prior to issuance of a building permit, the applicant shall provide a drainage and utility easement for the water quality pond to the high water elevation. The easement shall also include the storm sewer pipe outfall for the water quality pond. Resolution 2006-087 File No. 2005149 Page 3 11. Standard Conditions: a. The applicant shall remove any diseased or hazardous trees. b. All signage shall comply with the Section 21155 of the Zoning Ordinance. c. Building permits are required prior to the commencement of any constriction related to the project. d. Prior to issuance of a building permit, tree preservation and silt fence shall be installed on- site, and inspected and approved by City staff. e. All mechanical equipment shall be screened or painted to match the building in conformance with the Zoning Ordinance. f. Prior to issuance of a building permit, the location of the trash and recycling storage shall be identified on the plans. All trash and recycling storage shall be in conformance with the Zoning Ordinance and Building Codes. d. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. e. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09, 21030.06 and 21015.07 of the Zoning Ordinance.
