HomeMy WebLinkAboutCity Council Resolution 2006-084CITY OF PLYMOUTH RESOLUTION 2006-084 APPROVING AN INTERIM USE PERMIT FOR WOODY' S GRILLE, COUNTRY INN & SUITES AND TWO CARLSON PARKWAY, LOCATED AT 220 CARLSON PARKWAY, 210 CARLSON PARKWAY, AND 2 CARLSON PARKWAY (2005114) WHEREAS, Archer Design and Build, has requested approval of an interim use permit for reduced parking located at 220, 210, and 2 Carlson Parkway; and WHEREAS; the subject property is legally described as follows: PARCEL 1 Lot 1, Block 1, Carlson Center 12th Addition, according to the recorded plat thereof, Hennepin County, Minnesota. PARCEL 2 Lots 2 and 3, Block 1, Carlson Center 12th Addition. That part of Lot 1, Block 1, Carlson Center 15th Addition lying north of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes 35 seconds west a distance of 213.19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. PARCEL 3 That part of Lot 1, Block 1, Carlson Center 15th Addition lying south of the following described line: Commencing at the southeast corner of said Lot 1; thence north 1 degree 27 minutes 59 seconds east along the east line of said Lot a distance of 342.65 feet; Resolution 2006-084 Page 2 (2005114) thence north 5 degrees 30 minutes 16 seconds west along the east line of said Lot a distance of 92.74 feet to the beginning of the line to be described; thence south 81 degrees 09 minutes 35 seconds west a distance of 213.19 feet; thence north 27 degrees 52 minutes 34 seconds west a distance of 71.53 feet to a point on the northeasterly line of said Lot and said line there terminating. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Archer Design and Build for an interim use permit, subject to the following findings and conditions: 1. An interim use permit for reduced parking is approved, in accordance with the application materials received by the City on September 8, 2005, and revised plans received by the City on December 30, 2005, except as amended by this resolution. 2. The interim use permit allows a parking reduction of 57 parking spaces between Country Inn and Suites, Woody's Grill, and Two Carlson Parkway office building, based on the finding that the applicable interim use standards have been met. 3. The outdoor patio area shall not include seating for more than 80 people. 4. The interim use permit allows continued joint use of up to 26 parking spaces between Country Inn and Suites, Woody's Grill, and Two Carlson Parkway office building. 5. The interim use permit for reduced parking shall terminate if any of the following events occur: a. The use of any of the buildings changes to a use that increases the need for parking spaces. b. City staff documents a parking problem associated with inadequate parking. c. The floor area of any of the buildings is increased 6. All parking shall be off-street in designated areas that comply with the Zoning Ordinance. 7. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 8. This permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation.
