HomeMy WebLinkAboutCity Council Resolution 2006-038CITY OF PLYMOUTH RESOLUTION NO. 2006-038 RESOLUTION IMPOSING A CIVIL PENALTY AGAINST ASIAN MIL, INC. d/b/a TEA HOUSE RESTAURANT FOR LIQUOR COMPLIANCE CHECK VIOLATION WHEREAS, the Plymouth Police Department routinely conducts compliance checks on licensed liquor establishments within the City; and WHEREAS, during one of these checks conducted on September 30, 2005, an individual employed at the Tea House Restaurant, 88 Nathan Lane, sold alcoholic beverage to an underage person; and WHEREAS, that individual has appeared in Hennepin County District Court and been found guilty of this violation; and WHEREAS, this establishment had a previous compliance check violation which occurred on October 3, 2004, which is within the three-year period the ordinance requires making this the second violation at this establishment; and WHEREAS, Minnesota State Statute and Plymouth City Code allow for administrative civil penalties against the license holders for such violations. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, that the City Council adopts the Resolution imposing a civil penalty against Asian Mill, Inc. d/b/a The Tea House Restaurant for an imposition of a $1,000 fine and a 10 -day license suspension for a second violation. Adopted by the City Council on January 10, 2006.
