RESOLUTION NO. 2006 - 036
AUTHORIZE THE VACATION OF THAT PART OF PLATTED
GLEN GROVE AVENUE RIGHT-OF-WAY
(NOW KNOWN AS HARBOR LANE)
CONTIGUOUS TO LOT 1, BLOCK 1, GLEN GROVE ACRES
WHEREAS, a public hearing with respect to said vacation was scheduled for January 10, 2006 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the
meeting of January 10, 2006; and
WHEREAS, in accordance with State Statute 412.851, Chapter 117; Section 2, written notice was sent
by certified mail to the Commissioner of the Department of Natural Resources at least 60 days before
the hearing; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the Council did hold a public hearing on January 10, 2006 to inform any and all interested
parties relevant to the vacation of that part of Glen Grove Avenue in Glen Grove Acres plat; and
WHEREAS, it was determined by the City Council that said right-of-way was not needed for public
purposes;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following right-of-way be vacated:
That part of Harbor Lane North, formerly known as Glen Grove Avenue, lying northerly of the easterly
extension of the south line of Lot 1, Block 1, GLEN GROVE ACRES FIRST SUBDIVISION,
Hennepin County, Minnesota.

FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality
owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains
and hydrants thereon or thereunder, to continue maintaining the same or to enter upon such way or
portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
