RESOLUTION NO. 2006-019
AUTHORIZING THE MAYOR AND CITY MANAGER TO SIGN A
TERMINATION OF DECLARATION OF COVENANTS AND
RESTRICTIONS FOR LOTS 1 AND 2, BLOCK 1 WOODVIEW HEIGHTS

WHEREAS, property owners Andrew MacFarland (Lot 1, Blockl) and Trace Mills and
Tracey Flack (Lot 2, Block 1) have requested the City to authorize the Termination of
Declaration of Covenants and Restrictions applied to their Properties legally described as:
Lots 1 and 2, Block 1, Woodview Heights, Hennepin County, Minnesota
WHEREAS, the City Council required the declaration of covenants to be applied to Outlot
B, Tepley Addition as a requirement of the Tepley Addition final plat in 1986; and
WHEREAS, the City Council approved the Woodview Heights final plat in 2003 which
allowed the existing driveway to remain on the subject property in conflict with the
covenants; and,
WHEREAS, the property owners' legal counsel has prepared a Termination of Declaration
of Covenants and Restrictions, consistent with the City Council's 2003 approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request
for termination of the covenants, and
FURTHER, that the Mayor and City Manager be authorized to execute the Termination of
Declaration of Covenants and Restrictions on behalf of the City.
