HomeMy WebLinkAboutCity Council Resolution 2013-168CITY OF PLYMOUTH RESOLUTION No. 2013-168 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR GWS LAND DEVELOPMENT OF PLYMOUTH, LLC FOR "CREEKSIDE HILLS" FOR PROPERTY LOCATED AT 18940 AND 19010 STATE HIGHWAY 55 AND 13 EVERGREEN ROAD (201 3020) WHEREAS, GWS Land Development of Plymouth, LLC has requested approval of a preliminary plat for roughly 112 acres presently legally described as follows: TRACT 1: That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118, Range 22 described as follows: Beginning at a point which point is 123.7 feet South of the West Quarter corner of said Section 7; thence South 200 feet to the intersection of the West line of said Section 7 and the Northerly line of State Highway Number 55; thence Southeasterly along said Northerly line of said State Highway Number 55, 399.4 feet; thence Northeasterly along the extension of the radius of the last described course 92 feet; thence North and parallel to the West line of said Section 7, 250 feet; thence at an angle of 71 degrees 21 minutes left a distance of 402.6 feet to point of beginning, Hennepin County, Minnesota. Together with a driveway easement over Tract B, Registered Land Survey No. 133, see Order Doc No 3085759; (Now as to part of above land) Torrens Property - Torrens Certificate No. 1189071. TRACT 5: That part of the West 1/2 of the Northeast Quarter of the Southwest Quarter of Section 7, Township 118, Range 22, West of the 5th Principal Meridian, lying Northerly of the Northerly line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad, Hennepin County, Minnesota. Abstract Property. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by GWS Land Development of Plymouth, LLC for a preliminary plat for Creekside Hills, subject to the following conditions: A preliminary plat is approved for a 156 -lot single-family subdivision and a roughly 38 -acre parcel in the south portion of the site that would be added to the abutting Wayzata School District site, in accordance with the plat and plans received by the city on March 26, 2013, except as may be amended by this resolution. Resolution 2013-168 File 2013020 Page 4 2. Approval of the preliminary plat is contingent upon city council approval of the rezoning of the site to RSF-3 and P -I. 3. Not more than 75 of the 156 lots shall be final platted until the future major collector roadway (future 54th Avenue) is constricted on the property to the north, and the internal street system within the Creekside Hills plat is connected to 54t1' Avenue. 4. The developer must obtain approval of the wetland replacement plan application prior to, or in conjunction with, approval of final platting to subdivide residential lots within this development. 5. The final plat drawings shall indicate compliance with all city regulations regarding drainage and water quality. 6. Prior to recording the final plat for subdivision of the residential portion of the plat, the applicant shall: 1) pay sewer and water area assessments; 2) receive city approval of final constrictions plans; and 3) execute a development contract and submit related financial sureties. 7. The homeowner's association documents shall address: a) responsibilities for maintenance and repair of wetland buffers, buffer monuments, developer -installed retaining walls, sidewalks, and trails. b) prohibition of strictures and the clearing of vegetation within wetland buffers. 8. The sidewalks along all streets shall be installed at the same time the streets are installed. 9. No trees shall be planted in the public right-of-way. 10. The developer shall provide a reforestation plan showing an additional 735 caliper inches of new trees on the residential portion of the site upon submission of the first final plat application for subdivision of the residential area. 11. Standard conditions: a. No building permits shall be issued until the final plat, development contract, HOA documents, and all required easements and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall comply with the city's signage regulations. c. Development standards and setbacks for the RSF-3 area shall comply with the RSF-3 zoning standards. Development standards and setbacks for the P -I area shall comply with the P -I zoning standards. No variances are granted or implied. d. Street names shall comply with the city's street naming system. Resolution 2013-168 File 2013020 Page 5 e. Park dedication fee in lieu of land dedication shall be paid prior to recording of the final plat for the residential subdivision, and prior to issuance of building permits for any development in the south portion that would be owned by the school district. f. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. g. Compliance with the city's tree preservation regulations. h. Removal of all hazardous trees from the property at the owner's expense. i. This approval shall expire one year after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
