HomeMy WebLinkAboutCity Council Resolution 2013-167CITY OF PLYMOUTH RESOLUTION NO. 2013-167 A RESOLUTION APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED AT 18940 AND 19010 STATE HIGHWAY 55 AND 13 EVERGREEN ROAD FOR CREEKSIDE HILLS (201 3020) WHEREAS, GWS Land Development of Plymouth, LLC has requested reclassification of the zoning from FRD (future restricted development) to RSF-3 (single family detached 3) and P -I (public/institutional) for roughly 112 acres presently legally described as follows: TRACT 1: That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118, Range 22 described as follows: Beginning at a point which point is 123.7 feet South of the West Quarter corner of said Section 7; thence South 200 feet to the intersection of the West line of said Section 7 and the Northerly line of State Highway Number 55; thence Southeasterly along said Northerly line of said State Highway Number 55, 399.4 feet; thence Northeasterly along the extension of the radius of the last described course 92 feet; thence North and parallel to the West line of said Section 7, 250 feet; thence at an angle of 71 degrees 21 minutes left a distance of 402.6 feet to point of beginning, Hennepin County, Minnesota. TRACT 2: Par 1: That part of the Northwest Quarter of the Southwest Quarter of Section 7, Township 118, Range 22 described as follows: Beginning at the Northeast corner of said Northwest Quarter of the Southwest Quarter; thence West along the North line of said tract to the Northwest corner thereof, thence South along the West line of said Northwest Quarter of the Southwest Quarter of said Section 7 to the South line of State Think Highway No. 55; thence Southeasterly along said South line to its intersection with the North line of the right-of-way of the Minneapolis, St. Paul and Sault Ste. TRACT 4: Tract B, Registered Land Survey No. 1773, Hennepin County, Minnesota. Together with a driveway easement over Tract B, Registered Land Survey No. 133, see Order Doc No 3085759; (Now as to part of above land) Torrens Property - Torrens Certificate No. 1189071. TRACT 5: That part of the West 1/2 of the Northeast Quarter of the Southwest Quarter of Section 7, Township 118, Range 22, West of the 5th Principal Meridian, lying Northerly of the Northerly line of the Minneapolis, St. Paul and Sault Ste. Marie Railroad, Hennepin County, Minnesota. Abstract Property. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to RSF-3 and P -I. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-3 and P -I for roughly 112 acres located at 18940 and 19010 State Highway 55 and 13 Evergreen Road (as presently legally described above), based on the following findings: The RSF-3 zoning classification, as requested for the north portion of the site, is consistent with the LA -2 guiding for that portion of the site. Resolution 2013-167 (2013020) Page 4 2. The P -I zoning classification, as requested for the south portion of the site, is consistent with the LA -2 and P -I guiding for that portion of the site. 3. The proposed residential development and lot arrangement would comply with city standards. 4. The proposed lower density for the residential portion of the site would result in a development that balances preservation of the environment with reasonable and responsible use of land, and would also result in less impervious surface coverage, thereby reducing runoff to the creek. Furthermore, the proposed lower density would result in a development that would be compatible with the existing character of the surrounding neighborhoods. 5. Adequate infrastructure would be available to support RSF-3 and P -I zoning, as well as the residential development proposed for the site. ADOPTED by the City Council on May 28, 2013.
