HomeMy WebLinkAboutCity Council Resolution 2007-502CITY OF PLYMOUTH RESOLUTION 2007-502 APPROVING AN INTERIM USE PERMIT AMENDMENT FOR REDUCED PARKING FOR LIBERTY PROPERTIES LOCATED AT 9600 — 54TH AVENUE NORTH (2007106) WHEREAS, RIM Constriction has requested approval of an interim use permit amendment for Liberty Properties for property located at 9600 — 54t1' Avenue North, legally described as follows: Lot 2, Block 1, Loreli's Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by RIM Constriction an interim use permit amendment for property located at 9600 — 54th Avenue North, subject to the following conditions: 1. The interim use permit allows reduced parking at 9600 — 54th Avenue North, for as long as the parking lot on the adjacent RIM Constriction property to the north is used to cover the parking shortage on the site. 2. The applicant shall submit a legal document signed by representatives of RIM Constriction and Liberty Properties allowing joint parking of the 61 -space parking addition on the RIM Constriction property. 3. The shuttle service shall remain in effect until the parking lot is competed on the RIM property. 4. If the parking agreement with RIM to allow off site parking on the RIM property is discontinued or the City documents parking problems that cannot be resolved, the City may Resolution 2007-502 (2007106) Page 2 take action to revoke both the conditional use permit under resolution 2005-392 and this interim use permit amendment. 5. Any changes to this approval shall require Planning Commission and City Council consideration. 6. The "No Parking" restriction on 54th Avenue shall be enforced. 7. This approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. ADOPTED by the City Council on December 11, 2007.
