HomeMy WebLinkAboutCity Council Resolution 2007-501CITY OF PLYMOUTH RESOLUTION 2007-501 APPROVING A SITE PLAN AMENDMENT FOR A PARKING LOT EXPANSION AT RIM CONSTRUCTION LOCATED AT 5455 STATE HIGHWAY 169 (2007106) WHEREAS, RIM Constriction has requested approval of a site plan amendment for a 61 -stall parking lot expansion for property located at 5455 State Highway 169, for property legally described as: Lot 1, Block 1, Loreli's Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by RIM Constriction for a site plan amendment for a 61 -stall parking lot expansion at RIM Constriction, subject to the following conditions: 1. A site plan amendment is approved to allow a 61 -stall parking lot expansion on the RIM Constriction property for joint use by RIM Constriction and Liberty Properties, in accordance with the application materials received by the City on October 24, 2007, subject to the conditions listed below. 2. A separate 2radin2 permit is required prior to construction of the parking lot expansion. 3. Prior to issuance of a grading permit, the applicant shall: a. Receive approval of an administrative permit for outside storage on the property. b. Submit a legal document signed by representatives of RIM Constriction and Liberty Properties allowing joint parking of the 61 -space parking addition on the RIM Constriction property. Resolution 2007-501 File No. 2007106 Page 2 c. Provide a site improvement performance agreement and financial guarantee pursuant to Section 21045.10 of the Zoning Ordinance. d. Install silt fence for inspection by the City of Plymouth. e. Submit a private drainage easement from the property owner to the south for storm water discharge, drainage, and ponding purposes. The easement shall be from the end of the storm sewer discharge point to the frontage road of State Highway 169. f. Provide a rain garden maintenance agreement. g. Obtain all appropriate permits from the Minnesota Department of Transportation for storm water discharge. h. Submit revised plans showing the following: 1) The driveway grade at 5 percent or less. 2) The location of silt fence on the plans. 3) A planting plan for the rain garden. Include the planting locations, type of plant (plugs), and quantity. No seeding is allowed. 4) One additional catch basin on the south side of the parking lot immediately west of the driveway. 5) A storm sewer pipe under the proposed driveway. The area to the west of the driveway shall be graded to allow storm water to drain under the driveway. 6) The type of casting cover for the catch basin consistent with approved covers in the Engineering Guidelines. 7) Specify that "granite" shall be used for the type of rip rap adjacent to the fixed end section. 8) A double sided no parking/fire lane sign on each side of the drive aisle connection between the RIM Constriction property and the adjacent property to the south. 4. The storm sewer for the parking lot shall be designed to accommodate the five year rain event. 5. Any retaining wall exceeding 4 feet in height shall receive a building permit, be engineered, and shall have a minimum 3 -foot fence on top of the wall. 6. Standard Conditions: a. All signage shall comply with the Section 21155 of the Zoning Ordinance. b. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. c. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. g. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09 of the Zoning Ordinance.
