RESOLUTION 2007-500
APPROVING SITE PLAN AMENDMENT, CONDITIONAL USE PERMIT AMENDMENT
AND VARIANCES TO ALLOW AN EXPANSION AT MESSIAH UNITED METHODIST
CHURCH LOCATED AT 17805 COUNTY ROAD 6 (2007099)
WHEREAS, Messiah United Methodist Church has requested approval of a site plan amendment
conditional use permit amendment, and variances for a 15,790 -square foot church expansion
located at 17805 County Road 6, for property legally described as:
That part of the Southeast Quarter of the Southeast Quarter of Section 30, ToN-,reship 118, Range 22,
which lies South of the center line of County Road No. 6, as now laid out and opened, which center line is
described as follow: Beginning at the Southeast corner of said Section 30; thence North along the East line
thereof, a distance of 1062.0 feet, to the actual point of beginning of the line to the described; thence
deflecting to the left at an angle of 86 degrees 31 minutes, a distance of 1188.10 feet; thence deflecting to
the left along a 3 degree curve, a distance of 621.10 feet (delta angle of 18 degrees, '18 minutes, tangent
distance 313.30 feet); thence along tangent to the last mentioned curve to the West line of Government Lot
4, in Section 30 and there terminating.
Described as follows: Beginning at the intersection of the above described center line of County Road No.
6, N ith the West line of the Southeast Quarter of the Southeast Quarter of said Section 30; thence Easterly
along said center line to a point on said center line which point is 640.00 feet East of the West line of the
Southeast Quarter of the Southeast Quarter of said Section 30, as measured at right angles to said West
line; thence South and parallel to the West line of said Southeast Quarter of the Southeast Quarter, a
distance of 380.07 feet; thence NorthwesterIN- a distance of 640.75 feet to a point on the West line of said
Southeast Quarter of the Southeast Quarter, which point is 380.01 feet South from the point of beginning;
thence North along said West line, a distance of 380.01 feet to the point of beginning.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Messiah
United Methodist Church for a site plan amendment, conditional use permit amendment, and
variances, subject to the following conditions:
1. A site plan amendment, conditional use permit amendment and variances are approved to
allow constriction of a 15,790 -square foot expansion, in accordance with the application
materials received by the City on September 27, 2007, and revised plans received on
November 14, 2007, except as amended by this resolution.
2. Variances are approved to allow a 37 -foot front yard setback, where 50 feet is required by the
Zoning Ordinance and to allow a detached accessory stricture in the front yard, based on the
finding that:
a. The church addition would be separated from County Road 6 by a rain garden, existing
and proposed overstory trees and five feet of grade drop from the church to the roadway.
The addition would include the same setback as the existing church parking lot along
County Road 6. The addition would be constricted as a walkout to the back (west) side
of the church. This design provides a one-story view for half of the addition, which would
minimize the visual impact of the north elevation. The applicants are proposing to
constrict the additions and accessory building with materials and a design to match the
exterior of the church.
b. The conditions relating to the hardship are not generally applicable to other properties in
the RSF-I Zoning District. There are not many non-residential uses in residential districts
in the city. Each presents a set of unique circumstances related to the use of neighboring
properties. The church addition would be set back roughly 180 feet from the closest
residential home to the north. The accessory stricture would be set back 130 feet from
the apartment building to the south. The placement of the church on the property does not
allow for an accessible placement of an accessory stricture without a variance.
c. The variances would allow a reasonable use of the land and would not be detrimental to
the public welfare or injurious to other land in the neighborhood. The proposed setbacks
would not impair an adequate supply of light and air to adjacent property, endanger public
safety, increase congestion of the public streets, increase the danger of fire or substantially
diminish property values in the neighborhood.
d. The purpose of the variances is not based upon a desire to increase the value or income
potential of the parcel of land.
3. Separate building permits are required prior to commencement of the proiect.

4. Prior to issuance of any building permits, the applicant shall:
a. Complete a site improvement performance agreement and submit a financial guarantee
pursuant to Section 21045.10 of the Zoning Ordinance.
b. Submit a revised lighting plan in compliance with the power allowance requirements of
Section 21105.06 of the Zoning Ordinance.
c. Submit a revised landscape plan showing: 1) the four spruce trees on the north side of the
north addition as 10 foot high trees, 2) the existing mature spruce tree northeast of the
north addition as a saved tree, and 3) the trees on the west side of the sanctuary addition
as coniferous trees.
d. Vacate that portion of the existing drainage and utility easement located in the street right-
of-way of County Road 6 per Document Number 5000270.
e. Submit a 10 -foot drainage and utility easement along the south side of the north property
line.
f. Submit a rain garden maintenance agreement for both rain gardens.
g. Obtain all appropriate permits from: 1) Hennepin County for working in the street right-
of-way, removing the driveway entrance and boulevard restoration; 2) Minnesota
Department of Natural Resources if grading below the ordinary high water level; and 3)
Minnehaha Creek Watershed District.
h. Revise plans showing B612 curb and gutter in the parking lot.
i. Provide the lowest floor elevation for all building additions. The lowest building opening
where storm water may enter (door or window) must be a minimum of 18 inches above
the storm water overflow route.
j. Revise plans to change the 10 -inch PVC storm sewer pipe to 12 -inch RCP for all runs to
the southerly rain garden. Provide a manhole at the angle point. The clean out (as shown)
is not allowed. Show pipe size, percent of grade from catch basin number 2 to the new
catch basin. Include the new catch basin information.
k. Revise the utility plan to indicate that "granite" rip rap is required.
1. Provide a planting plan and cross section for the rain garden. Show planting type,
location and number of plugs. Remove the rain garden detail and provide a site-specific
design for each of the rain gardens. Revise sheet L 1 accordingly.
m. Submit a separate building permit for retaining walls exceeding four feet in height. The
walls must be engineered and must have a minimum three-foot high fence on top of the
wall.
n. Add a note to the utility plan that "all work and materials shall conform to the City of
Plymouth's standard specifications.
5. Fire Conditions:
a. Relocate the fire department connection to an approved location at the main entry door.
b. Relocate the post indicator valve to an approved location.
c. Relocate the north hydrant to an approved location on the east side of the north drive.
d. The trash enclosure must be entirely constricted of non-combustible materials if there is a
roof on the enclosure.

e. Submit turning radius evaluations for fire department apparatus in all drive aisles.
Apparatus contact with curbs, extending over the face of curbs or extending into parking
spaces is not permitted.
f. Approved paved access to all door locations on the south, west and north sides from the
parking lot is required.
g. Fire lane signs are required in approved locations in the parking lot and drive aisle areas as
identified by the Fire Inspector.
6. The applicant shall obtain any necessary State of Minnesota licenses to relocate the children's
outdoor play area. The children's play area shall be enclosed with a six-foot high fence.
7. All mechanical equipment shall be located out of the 15 -foot wetland stricture setback.
8. Silt fence shall be installed prior to any constriction on the site.
9. All rooftop equipment shall be screened or painted to match the building.
10. Standard Conditions:
a. The applicant shall remove any diseased or hazardous trees.
b. New signage shall receive sign permits when required and shall comply with the Section
21155 of the Zoning Ordinance.
c. Building permits are required prior to the commencement of any constriction related to
the project.
d. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
e. The permit is subject to all applicable codes, regulations and ordinances, and violation
thereof shall be grounds for revocation.
f. This approval shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Sections 21045.09 and 21015.07 of the Zoning
Ordinance.
