RESOLUTION 2007-487
APPROVING A VARIANCE FOR A SECOND FREESTANDNG SIGN FOR AGA MEDICAL
FOR PROPERTY LOCATED AT 5050 NATHAN LANE NORTH (2007095)
WHEREAS, Serigrahics Sign Systems, LLC. has filed an application to allow a second
freestanding sign where one is allowed for property legally described as follows:
Lot 1, Block 1 and Outlot A, Northwest Bell, Plymouth Office lit Addition, according to the
recorded plat thereof, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by
Serigraphics Sign Systems, LLC. for a variance to allow a second freestanding sign at AGA
Medical at 5050 Nathan Lane, subject to the following conditions:
1. This resolution approves a variance to allow a second freestanding sign installed near the
intersection of Schmidt Lake Road and the Highway 169 frontage road in accordance with the
plans and application received by the City on September 19 and October 8, 2007, except as
amended by this resolution.
2. The variances are approved with the finding that the applicable variance standards are met.
Specifically:
a. The lot is 26.6 acres in area and contains a medical device campus in one building. The
building is located in the center of the site and has limited visibility from Schmidt Lake
Road due to the distance and landscaping. The wall signs and existing freestanding sign
provide appropriate direction from Nathan Lane and some visibility from the frontage
road, but are not visible from Schmidt Lake Road. Consequently, the size and location of
the improvements on the lot create a hardship for the applicant.
b. Few single -building industrial properties have the acreage AGA has. The size of the
parcel and the location of the building are not common to most I-2 zoned properties.
c. The request is not based exclusively upon a desire to increase value or income potential of
the property, but to provide improved visibility for out-of-town clients and visitors who
use Schmidt Lake Road to access the property.
d. Although the Sign Ordinance was designed to allow industrial properties with more than
20 acres to have larger signs, the ordinance did not anticipate a situation like the
applicant's where neither a larger freestanding sign nor additional wall signs could

produce the necessary visibility. The situation and hardship are unique to this parcel and
the hardship was caused by the Zoning Ordinance rather than being self-created.
e. Granting the variance will not be detrimental to the public welfare or injurious to other
land or improvements in the neighborhood.
f. The variance would not impair an adequate supply of light and air to any adjacent
property, nor would it substantially increase the congestion of the public streets, or
increase the danger of fire, or endanger the public safety, or substantially diminish or
impair property values within the neighborhood.
g. The requested variance, with the condition limiting the size and height of the freestanding
signs, is the minimum action necessary to eliminate the hardship.
3. Sign and electrical permits are required prior to installation of the sign.
4. The combined square footage of both freestanding signs shall not exceed 160 feet and neither
sign shall exceed 10 feet in height.
5. Any subsequent phases or expansions are subject to required reviews and approvals per
Ordinance provisions.
6. This variance approval shall expire one year after the date of approval, unless the applicant has
installed the sign, or unless the applicant has received prior approval from the City to extend
the expiration date for up to one additional year, as regulated under Section 21030.06 of the
Zoning Ordinance.
