HomeMy WebLinkAboutCity Council Resolution 2007-439CITY OF PLYMOUTH RESOLUTION 2007-439 APPROVING FINDINGS OF FACT FOR THE REZONING OF LAND LOCATED NEAR THE SOUTHEAST CORNER OF THE INTERSECTION OF COUNTY ROAD 47 AND JUNEAU LANE (2007066) WIIEREAS, LCS, LLC., has requested reclassification of the zoning from FRD to PUD and P -I for the 46.36 -acre parcel located at the southeast corner of the intersection of County Road 47 and Juneau Lane, presently legally described as follows: Parcel 1: That portion of the Southeast Quarter of the Northeast Quarter (SE '/4 of the NE '/4) of Section 4, Tov reship 118, Range 22, lying Southerly of Hennepin County Highv ay 47, except for the folloNving tracts of land: Tract 1: The East 200 feet of the Southeast Quarter of the Northeast Quarter (SE '/4 of the NE '/4) of Section 4, Tovnship 118, Range 221ying Southerly of Hennepin County Highv ay No. 47; and Tract 2: That part of the East Half of the Northeast Quarter (E % of the NE '/4) of Section 4, Township 118 North, Range 22 West, Hennepin County, Minnesota, described as beginning at the point of intersection of the center line of County Road No. 47 and a line parallel vith and 223.00 feet Easterly, as measured at right angles, from the West line of the East Half of said Northeast Quarter (E % of said NE '/4); thence South along said parallel line a distance of 162.34 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 190.00 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 165.25 feet to the center line of County Road 47; thence West along said center line to the point of beginning. Parcel 2: That part of the East Half of the Northeast Quarter (E % of the NE '/4) of Section 4, Township 118, Range 22 West, Hennepin County, Minnesota, described as beginning at the point of intersection of the center line of County Road 47 and a line parallel vith and 223.00 feet Easterly, as measured at right angels, from the West line of the East Half of said Northeast Quarter (E % of the NE '/4); thence South along said parallel line a distance of 162.34 feet; thence deflecting to the left 90 degrees 00 minutes, a distance of 190.00 feet; thence deflecting to the left 90 degrees 00 Resolution 2007-439 (2007066) Page 2 minutes, a distance of 165.25 feet to the center line of County Road No. 47; thence West along said center line to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to PUD (Planned Unit Development) and P -I (Public/Institutional). NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to PUD and P -I for the 46.36 -acre parcel at the southeast corner of the intersection of Juneau Lane and County Road 47, based on the following findings: 1. The proposed development, with 10.3 dwellings per acre, is consistent with the LA -3 land use designation and the open space outlot is consistent with the P -I land use designation on the Comprehensive Plan land use guide plan map. 2. The proposed development would preserve the majority of the stand of existing trees on the west side of the property by clustering the development in larger buildings as permitted in areas guided LA -3. 3. The proposed development would meet the purpose and intent of the PUD and P -I zoning districts by providing a mix of residential uses and open spaces for parks and trails. 4. With the required improvements, there is adequate infrastructure to serve the proposed development. 5. The development proposes adequate transitions between the higher density development proposed and the adjacent existing land uses. 6. The development proposes housing types for a special needs elderly population and would be the only skilled nursing care center in Plymouth. ADOPTED by the City Council on October 9, 2007.
