RESOLUTION NO. 2007-425
ACCEPTANCE OF UTILITIES FOR CONTINUAL MAINTENANCE
HADLEY HILLS 2ND ADDITION (2005024)
WHEREAS, in accordance with the development contract dated November 8, 2005, The
Ridge at Hadley Hills, Inc., developer of Hadley Hills 2" a Addition (2005024), has agreed
to install certain improvements for said development; and
WHEREAS, the developer has completed a portion of the street and utility work as noted
below; and
WHEREAS, the developer has requested acceptance of the utilities for continual
maintenance;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements
be reduced as follows:

Boulevard and Drainage Swale Sod
Street and Traffic Control Signs

Landscaping

That the required financial guarantee for the above items be reduced as detailed above
from $341,687 to $240,887 to reflect the completed work. Letter of Credit No. 1797 may
be reduced accordingly.

FURTHER BE IT RESOLVED that the financial guarantee requirements for the
following items per Section 8.1 of the approved development contract remain as follows:

Guarantee Requirements)

FURTHER BE IT RESOLVED that the utilities be accepted for continual maintenance as
of October 9, 2007 subject to the two-year guarantee by the Developer per the $26,969
held in Letter of Credit No. 1797.
