HomeMy WebLinkAboutCity Council Resolution 2007-425CITY OF PLYMOUTH RESOLUTION NO. 2007-425 ACCEPTANCE OF UTILITIES FOR CONTINUAL MAINTENANCE HADLEY HILLS 2ND ADDITION (2005024) WHEREAS, in accordance with the development contract dated November 8, 2005, The Ridge at Hadley Hills, Inc., developer of Hadley Hills 2" a Addition (2005024), has agreed to install certain improvements for said development; and WHEREAS, the developer has completed a portion of the street and utility work as noted below; and WHEREAS, the developer has requested acceptance of the utilities for continual maintenance; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA; that the financial guarantee requirements be reduced as follows: ITEM Street Constriction Sanitary Sewer Watermain Storm Sewer Site Grading and Drainage Improvements Boulevard and Drainage Swale Sod Street and Traffic Control Signs Retaining Walls Landscaping Buffer Posts Setting Iron Monuments Design, Administration, Inspection, As- Bullts TOTAL ORIGINAL CURRENT NEW AMOUNT AMOUNT AMOUNT $ 93,368 $ 37,300 $37,300 27,937 11,200 6,984 45,535 18,200 11,384 34,638 13,900 8,660 79,212 35,000 17,500 1,200 1,200 1,200 1,000 1,000 -0- 64,128 64,128 10,000 118,750 118,750 118,750 1,100 1,100 -0- 3 300 3 300 3 300 56,420 36,609 25,809 $526,588 $341,687 240,887 That the required financial guarantee for the above items be reduced as detailed above from $341,687 to $240,887 to reflect the completed work. Letter of Credit No. 1797 may be reduced accordingly. Resolution No. 2007-425 Hadley Hills 2 N (2005024) Page 2 of 2 FURTHER BE IT RESOLVED that the financial guarantee requirements for the following items per Section 8.1 of the approved development contract remain as follows: ITEM Maintenance of Erosion and Sediment Control Plan, Street Sweeping, and Storm Sewer Cleaning (see Grading Permit for Financial Guarantee Requirements) Cash: Financial Guarantee: LC 1806 ORIGINAL NEW AMOUNT AMOUNT $ 1,000 $ 1,000 $5,870 $5,870 FURTHER BE IT RESOLVED that the utilities be accepted for continual maintenance as of October 9, 2007 subject to the two-year guarantee by the Developer per the $26,969 held in Letter of Credit No. 1797. Adopted by the City Council on October 9, 2007.
