RESOLUTION 2007-416
APPROVING A SITE PLAN AND SETBACK VARIANCES AND DENYING A SIGN
VARIANCE FOR QUEST DEVELOPMENT, INC. FOR PROPERTY LOCATED AT
10600 OLD COUNTY ROAD 15 (2007074)
WHEREAS, Quest Development, Inc. has requested approval of a site plan, building
setback variances, parking setback variances, and a wall signage area variance in
conjunction with their proposal to constrict a 9,700 square foot medical office building on
the roughly one -acre site located at 10600 Old County Road 15, legally described as
follows:
That part of the Northeast Quarter of the Southwest Quarter of Section 36,
Township 118 North, Range 22 West of the 5"' Principal Meridian, lying between
the Southwesterly right of way line of State Highway No. 55 and the Northerly right
of way line of County Road No. 6, and Easterly of the following described line to -
wit: Beginning at a point in the Southwesterly right of way line of said State
Highway No. 55, distant 215 feet Southeasterly measured along said Highway right
of way line, from the North line of said Northeast Quarter of the Southwest Quarter;
thence Southwesterly on a line perpendicular to the Southwesterly right of way line
of said Highway a distance of 163.65 feet, more or less, to the Northerly right of
way line of said County Road No. 6 and there terminating, according to the United
States Government Survey thereof.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
requested site plan and setback variances, and that it should and hereby does deny the
requested wall signage area variance, by Quest Development, Inc. for property located at
10600 Old County Road 15, subject to the following findings and conditions:

1. A site plan allowing constriction of a 9,700 square foot medical office building and
related variances for reduced building and parking setbacks are hereby approved in
accordance with the plans received by the City on August 2, 2007, August 3, 2007,
August 10, 2007, and elevation plans received by the City on September 13, 2007,
except as may be amended by this resolution.
2. The requested variances for reduced building and parking setbacks are approved based
on the finding that all applicable variance standards have been met.
3. The requested variance for increased area for wall signage (to allow 10% where 5% is
specified) on the north wall of the building is denied based on the finding that the
applicable standards are not met. Specifically, there is no hardship related to signage
denying the applicant a reasonable use of the property. Additionally, the signage
conditions are not unique to this O (Office) parcel. The same signage conditions and
regulations apply to all other O (Office) zoned parcels.
4. The private cross -parking easement for the twelve parking spaces located along the
west boundary of the site shall not be terminated or modified without prior consent by
the City of Plymouth.
5. Prior to construction of the building, the applicant must obtain separate approval of
a building permit.
6. Prior to issuance of building permits, the following items shall be completed:
a. The developer shall submit the required Financial Guarantee and Site Improvement
Performance Agreement.
b. The applicant shall pay the park dedication fee in lieu of land dedication, in
accordance with the Dedication Ordinance in effect at the time of building permit
issuance.
c. The developer shall obtain the necessary permits and approvals as follows: Bassett
Creek Watershed Management Organization, Minnesota Department of Health,
MPCA, Mn/DOT, Wetland Conservation Act, and NPDES.
d. A rain garden maintenance agreement is required.
e. A letter verifying wetland status is required.
f. Cross easements are required for unobstructed access.
g. The developer shall provide a five-foot wide sidewalk easement adjacent to Old
County Road 15in the area between the site entrance (curb cut) and west lot
line.
h. The developer shall provide an agreement waiving their right to appeal the
assessment for installation of a future sidewalk.

7. Prior to issuance of building permits, the plans shall be revised as follows:
a. Both of the landscape keys on the Landscape Plan (Plan L1-1) shall clearly indicate
that deciduous trees shall be a minimum of 2.5 caliper inches and that coniferous
trees shall be a minimum of six feet in height.
b. A walkway (with pedestrian ramps) shall be provided from the main building
entrances to the intersection of Old County Road 15 and Union Terrance Lane.
c. A sidewalk shall be provided along the north side of Old County Road 15 adjacent
to the sitein the area between the site entrance (curb cut) and the west lot line.
d. Indicate B612 concrete curb and gutter for the parking lot.
e. The drive aisles shall be constricted to a 7 -ton design, and the parking stalls shall
be constricted to at least a 5 -ton minimum design. Provide City detail STRT-2.
f. Add a note stating "The contractor shall contact Sewer and Water Department at
(763) 509-5950 at least 48 hours prior to any public sewer/watermain connection".
g. The site plan shall comply with the City of Plymouth's current Engineering
Guidelines or the State Plumbing Code, whichever applies.
h. Include the City of Plymouth's Engineering Guidelines and Standard Detail
Specifications in the contract documents. All work must be done to these
requirements. Add this note to the Utility Plan General Notes on page C4-1.
i. Provide City details of the current Engineering Guidelines dated March, 2007.
j. Watermain shall be C900 PVC. Remove the reference to DIP Class 52 under Note
11 on page C4-1, and to the 6 -inch water line in the plan view.
k. Add a note for the proposed watermain wet tap on Old County Road 15 that the
roadway must be restored within 48 hours, and must match the existing road
surface.
1. Add a note to core drill the new sanitary sewer connection.
m. Show the existing sewer and water services to the existing building. They will
need to be abandoned back to the mains.
n. Provide a planting plan for the rain garden. Include type and quantity of plugs.
No seed is allowed. Revise reference to the rain garden on page L 1-1.
o. There must be no increase in runoff rates. Provide drainage calculations
demonstrating this.
p. The storm water from the roof, sidewalk, and the easterly parking lot should go to
a water treatment area.
q. If MnDOT allows the existing catch basin located in the easterly parking lot to
remain, the buried fixed end section shall be uncovered and graded to drain.
Remove the stricture from the plans if it is to be removed.
r. Identify if the proposed storm sewer pipe under the new driveway collects water
from the public street.
s. An encroachment agreement is requirement for the retaining wall in the drainage
and utility easement.
t. Identify the Post-Indicater Valve location.

u. Identify the fire department connection at the the entry door area.
v. Locate a fire hydrant in an approved location at the east entry drive.
w. Provide turning radius evaluations.
x. The domestic water supply line shall not exceed one-fourth the size of the water
supply unless an approved solenoid device is connected. Indicate on plans.
y. Provide screening between the seven parking spaces facing south and the
residential area south of Old County Road 15. Revise the landscape plan (Plan L1-
1) accordingly.
z. Identify that the twelve parking spaces that the cross the west lot line would be
designated and signed for use by the proposed medical office building. Indicate
signage locations on the plans.
8. Standard Conditions:
a. Signage shall be in compliance with the City's sign regulations, and shall receive
prior approval of the appropriate sign permit.
b. Compliance with the City's lighting regulations, including requirements for house -
side shielding.
c. An approved fire lock box is required at the main building entrance.
d. The applicant shall submit reproducible mylar prints of sanitary sewer, water
service, storm sewer and pond as-builts prior to any reduction or release of the
financial guarantee.
e. The applicant shall submit a reproducible 8 '/z x 11 inch "As Built" Fire Protection
Plan prior to the release or reduction of any site improvement financial guarantee.
f. Any subsequent phases or expansions are subject to required reviews and
approvals per Ordinance provisions.
g. This permit is subject to all applicable codes, regulations and ordinances, and
violation thereof shall be grounds for revocation.
h. This approval shall expire one year after the date of approval, unless the property
owner or applicant has substantially started constriction of the project, or unless
the landowner or applicant has received prior approval from the City to extend the
expiration date for up to one additional year, as regulated under Sections 2 103 0. 06
and 21045.09 of the Zoning Ordinance.
