HomeMy WebLinkAboutCity Council Resolution 2007-411CITY OF PLYMOUTH RESOLUTION 2007-411 APPROVING A SITE PLAN, CONDITIONAL USE PERMITS, AND VARIANCES FOR DUKE REALTY, LP TO ALLOW CONSTRUCTION OF TWO OFFICE BUILDINGS FOR PROPERTY LOCATED IN THE NORTHWEST QUADRANT OF HIGHWAY 55 AND HIGHWAY 169 (2007071) WHEREAS, Duke Realty, LP has requested approval of a site plan, conditional use permits, and variances for a new office development on the 18.3 -acre parcel located in the northwest quadrant of Highway 55 and Highway 169, legally described as follows: Tract A: Outlot A, Groves Office Park 2" a Addition, according to the recorded plat thereof, Hennepin County, Minnesota. A portion of the above described land is registered property as evidenced by Certificate of Title No. 725560 and is described as follows: Parcel 1: That part of Outlot A, Groves Park Office Park 2" a Addition lying West of the East 17 feet of the Southwest Quarter of the Northeast Quarter of Section 36, Township 118, Range 22 and North of the South line of said Southwest Quarter of the Northeast Quarter. Parcel 2: That part of Outlot A, Groves Office Park 2" a Addition, lying North of the center line of vacated Ninth Avenue (formerly Huron Avenue) and its Westerly extension and West of the East line of Lot 19, Plymouth Gardens and its Southerly extension to said center. Tract B: Non-exclusive easement as contained in Easement Agreement dated July 20, 1993, recorded November 23, 1993 as Document Number 6187805 in the Office of the County Resolution 2007-411 (2007071) Page 2 Recorder, Hennepin County, Minnesota and as supplemented be Amended and Restated easement agreement dated June 12, 1995, recorded June 30, 1995 as Document Number 6445227 recorded in the office of the County Recorder, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public hearing, and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Duke Realty, LP for a site plan, conditional use permits, and variances for the 18.3 -acre parcel located in the northwest quadrant of Highway 55 and Highway 169, subject to the following conditions: 1. The site plan allowing constriction of an office development containing two buildings with 125,000 square feet per building (250,000 total square feet of office space) together with two conditional use permits and two variances are hereby approved, in accordance with the plans received by the City on July 26, 2007, except as may be amended by this resolution. 2. Approval of the site plan is contingent upon City Council approval of 1) final platting of the site, and 2) the Wetland Replacement Plan application. 3. The conditional use permit requested to allow two principal buildings on the site is approved, based on the finding that all applicable specific and general conditional use standards have been met. 4. The conditional use permit requested to allow the height of the buildings to be increased to 58-68 feet is approved, based on the finding that all applicable specific and general conditional use standards have been met. 5. The variance requested to allow reduced parking stall depth/drive aisle width is approved, based on the finding that all applicable variance standards have been met. 6. The variance requested to allow reduced parking setback is approved, based on the finding that all applicable variance standards have been met. 7. The developer shall install a five-foot wide concrete sidewalk along one side of 91h Avenue and along one side of Nathan Lane serving this office development. 8. The constriction and maintenance of the center island in 91h Avenue shall be the responsibility of the owner of the office development. 9. No medical/medical office uses (including dental and chiropractic uses) shall be allowed unless required parking is met. Resolution 2007-411 (2007071) Page 3 10. Prior to issuance of building permits, the following items shall be completed: a. The applicant shall submit the required Financial Guarantee and shall execute a Site Improvement Performance Agreement or Development Contract as required by the City. b. The applicant shall pay the park dedication fee in lieu of land dedication, in accordance with the Dedication Ordinance in effect at the time of building permit issuance. c. A 20 -foot wide drainage and utility easement shall be provided for the sanitary sewer from manhole I to the mainline. A 20 -foot wide drainage and utility easement shall be provided over the existing storm sewer from stricture 122 to the fixed end section in the pond, and from stricture 122 north to the 9th Avenue cul-de-sac. d. The vacation of a portion of the 9th Avenue cul-de-sac and drainage and utility easement is required for the new alignment. A separate request from the property owner is required along with a $450.00 fee. City Council approval is required for the vacation. e. A rain garden maintenance agreement is required. 11. Prior to issuance of building permits, the following revisions shall be made to the plans: a. Replace green ash on plans C9 and C9b with a different tree species, as approved by the City Forester. b. A 120 -foot diameter cul-de-sac shall be indicated for 9th Avenue. c. B612 concrete curb and gutter shall be indicated for the parking lot areas, and B618 concrete curb and gutter shall be indicated for the public streets. d. The lowest floor elevation shall be a minimum of two feet higher than the high water elevation for adjacent ponds or wetlands. Provide the lowest floor elevation on the plans. In addition, there must be a minimum of 18 inches of freeboard between the lowest building opening where storm water can enter (doors or windows) and the emergency overland overflow elevation. e. Add a note stating "The Contractor shall contact Sewer and Water Department at (763) 509-5950 at least 48 hours prior to any public sewer/watermain connection". f. Add a note on page C8 to contact the public works department 48 hours prior to any work in the public street right-of-way. g. Add a note to the plans not to allow compaction by constriction equipment, or storage of materials in the proposed rain garden area. h. Include the City of Plymouth's standard detail specifications in the contract documents. i. The minimum width of 9th Avenue and Nathan Lane shall be 32 feet as measured from back of curb to back of curb. The pavement width between the outside curb of the turn- around and such island shall be between 22-24 feet wide. j. Concrete drive aprons per City detail STRT-14 shall be shown for all private driveways on 9th Avenue and Nathan Lane. k. The curbed island located at the throat of the 9th Avenue cul-de-sac and the intersection of 9th Avenue and Kilmer Lane shall be constricted per City detail STRT-5. 1. Add striping east of the curbed island at the throat of the 9th Avenue cul-de-sac. m. A street signage and street lighting plan is required for the public streets. Resolution 2007-411 (2007071) Page 4 n. Identify ADA pedestrian ramp locations for the proposed sidewalk. o. On page C5 modify note 6 to read "all private curb and gutter". On note 8 add "see detail STRT-14". Add Note 9 to read "Contact the City of Plymouth's Engineering Department prior to working in public right-of-way". p. On page C6 add to the end of note 16 "for private driveways and parking lots. See detail STRT-2 for public roadways". q. Identify the normal and high water elevation for the existing pond. r. On page C8 note that the sanitary sewer connection must be core drilled, and that no inside drop over 2 feet is allowed. The City does not have a detail San -19A as indicated on the plans. s. Note on the plans the locations of shallow storm sewer (48 inches or less) and add a note that sand bedding down to 48 inches from finished grade is required. t. Show the drain tile for the public streets and reference City detail ST -9. u. It appears that the elevation for stricture 122 is too shallow for a 24 inch pipe with a slab and casting. Revise plans accordingly. v. Add a trash guard to all fixed end sections with pipes 24 inches or larger. Reference strictures 100, 110, and 125. w. The watermain must be connected to Kilmer Lane through 9th Avenue. x. The proposed salvaged fire hydrant (number 7) must be replaced with a new one. Identify where the salvaged hydrant is coming from. Wet tap a 12 inch x 6 inch gate valve for the new hydrant lead. y. Increase the sanitary sewer pipe size for both buildings from 6 inches to 8 inches. z. Add note number 16 to page C8 to read "Bacteria testing of the watermain is required in accordance with the City of Plymouth's Engineering Guidelines". aa. Any retaining walls four feet or higher require an engineered wall with a fence on top. A separate permit is required from the Building Department. bb. Retaining walls shall not be located within a drainage and utility easement. All walls shall have enough horizontal separation away from existing utilities so that fi ture work on the utilities will not undermine the structural stability of the wall. cc. Remove all plantings from the public street right-of-way, except for the 9t1' Avenue cul- de-sac island. Remove the plantings from the drainage way north of the 9th Avenue cul- de-sac. Show the revisions on page C9. dd. Provide storm water emergency over flow (EOF) locations and elevations for the streets and parking lot. ee. The demolition/reconstruction of Nathan Lane and 9th Avenue, as shown on plan C2 and plan C7, shall meet the City's standard specifications for street constriction. ff. Demonstrate how the storm water along the east side of the easterly parking lot is not blocking the existing path of the water, and will drain between the proposed parking lot and property line. Off-site storm water shall not drain onto the proposed parking lot. Resolution 2007-411 (2007071) Page 5 12. The developer shall obtain the necessary permits and approvals as follows: Bassett Creels Watershed District, Wetland Conservation Act, Minnesota Department of Health, Minnesota Department of Natural Resources, Minnesota Pollution Control Agency, Army Corps of Engineers, and NPDES. 13. The site plan shall comply with the City of Plymouth's current Engineering Guidelines or the State Plumbing Code, whichever applies. 14. The reconstructed 9t1' Avenue shall provide two curb cuts to the abutting property on the south side of 9th Avenue, in accordance with an approved design and plans by the City Engineer. 15. Rooftop equipment shall be screened in compliance with the Zoning Ordinance. 16. Trash and recycling storage shall be in compliance with the Zoning Ordinance. 17. Any signage shall be in compliance with the City's sign regulations, and shall receive prior approval of the appropriate sign permit. 18. Prior to issuance of the certificate of occupancy, a Transportation Demand Management (TDM) Program shall be submitted for staff review and approval. 19. Standard Conditions: a. The applicant shall submit a reproducible 8 1/2 x I I inch "As Built" Fire Protection Plan prior to the release or reduction of any financial guarantees. b. The applicant shall submit reproducible mylar prints of sanitary sewer, water service, storm sewer, and pond As-Builts for the site prior to the release or reduction of any financial guarantees. c. Fire hydrants, hydrant valves, post indicator valves, address directional signage, and fire department connections shall be placed in locations as approved by the Fire Inspector. d. The site plan, conditional use permits, and variances shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Sections 21045.09, 21015.07, and 21030.06 respectively, of the Zoning Ordinance.
