RESOLUTION NO. 2007-367
REQUEST FOR PAYMENT NO. 3 AND FINAL
WELL NO.'S 7 AND 12 MAINTENANCE PROJECT
CITY PROJECT NO. 5133
WHEREAS, the City of Plymouth as owner and Bergerson Caswell Inc., as contractor,
have entered into an agreement for Well No.'s 7 and 12 Maintenance Project, City
Project No. 5133, said agreement being dated March 24, 2006; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $121,187.50. One change order
was approved in the amount of $66,775.00 and the value of the work to
date is $170,057.50 and is herewith approved. The final contract cost is
9.6% less than the revised contract amount.
2. That the work performed by the contractor for Well No.'s 7 and 12
Maintenance Project and certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as
to the conditions of the performance bond, any and all legal rights of the
owner, required guarantees and correction of faulty work after final
payment.
3. Request for Payment No. 3 and Final in the amount of $8,502.87 to
Bergerson Caswell Inc. for Well No.'s 7 and 12 Maintenance Project is
hereby approved and the Administrative Services Director is hereby
authorized and directed to pay the same forthwith.
Adopted by the City Council on August 28, 2007.
