HomeMy WebLinkAboutCity Council Resolution 2007-353CITY OF PLYMOUTH RESOLUTION 2007-353 APPROVING A VARIANCE FOR FRONT YARD SETBACK FOR MARK PETERSON AND AMY PETERSON FOR PROPERTY LOCATED AT 320 TRENTON LANE NORTH (2007067) WHEREAS, an application has been filed by Mark Peterson and Amy Peterson for a front yard setback variance to allow constriction of a front porch addition for property legally described as follows: Lot 14 and that part of Lot 15 lying Easterly of line drawn from Northeast corner of said Lot 15 to a point on Southerly line of said Lot 15, distant 20.00 feet West, as measured along the South line thereof, from the southeast corner of said Lot 15, all in Block 2, Ivanhoe Woods, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed the request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Mark Peterson and Amy Peterson for a front yard setback variance to allow constriction of a front porch addition at 320 Trenton Lane North, subject to the following conditions: 1. This resolution approves a 17.3 -foot front setback variance for a 6.7 -foot by 9.8 -foot front porch addition, in accordance with the plans and application received by the City on July 9, 2007, except as amended by this resolution. 2. The variance for front setback is approved with the finding that the applicable variance standards are met. Specifically: a) The forward placement of the home on the lot would not allow any front porch without a variance, as the existing house is setback 24 feet from the front property line. The Resolution 2007-353 (2007067) Page 2 of 3 applicants state that they are proposing a 6.7 foot by 9.7 foot covered porch to prevent ice build-up at their front door. b) The circumstances related to this request are not generally applicable to other properties in the RSF-I district. The house was constricted prior to modern zoning regulations. The applicants must request a front setback variance to allow a modest front porch addition. In addition, the applicants would still have a 17 -foot front yard setback and 12 feet of right-of-way to the street. Staff finds that 29 feet from a residential home to a local street is a typical situation in Plymouth. c) The request is not based exclusively upon a desire to increase value or income potential of the property; but rather, the variance is necessary to constrict a covered front porch addition for the improved livability of the property owners. The proposed porch would not detract from the appearance of the home or surrounding properties. The applicants are proposing to constrict the porch addition with materials and design compatible with the exterior of the home. d) The conditions relating to the hardship were not created by the applicants, but date back to the original constriction and placement of the home in the 1950's. The applicants purchased the property in 1999. e) The granting of the variance would not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. The existing homes along this section of Trenton Lane have varied front setbacks. The neighboring homes to the east and southwest have similar front setbacks (roughly 18 feet) to the proposed setback variance (17.3 feet). Therefore, the reduced setback would not be incompatible with the adjacent houses on Trenton Lane. In addition, the applicants would design the porch addition to be consistent with the character of the home. f) The variance would not impair an adequate supply of light and air to adjacent property, nor would it substantially increase the congestion of the public streets, or increase the danger of fire, or endanger the public safety, or substantially diminish or impair property values within the neighborhood. g) The proposed front porch is modestly sized and represents the minimum action necessary to alleviate the hardship. 3. A building permit is required prior to construction of the porch addition. 4. Adjacent paved streets shall be kept free of mud, sand, and silt as a result of constriction. Resolution 2007-353 (2007067) Page 3 of 3 5. The addition shall comply with all standards specified for the RSF-I (Residential Single Family Detached 1) zoning district. No variance other than front setback variance is granted or implied. 6. The building materials of the porch shall match the exterior materials of the home. 7. Any subsequent phases or expansions are subject to required reviews and approvals per Ordinance provisions. 8. This variance approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 2 103 0. 06 of the Zoning Ordinance.
